- NASA/GSFC/Wallops Flight Facility (WFF) has a requirement for in-lieu fee credits to compensate for wetland impacts from construction of the Unmanned Aerial Systems Airstrip on Wallops Island, VA. NASA/GSFC/WFF intends to purchase the credits from The Nature Conservancy's Virginia Aquatic Resource Trust Fund in accordance with 6.302-1(a)(1) 10 U.S.C.2304(c)(1) - only one responsible source and no other supplies or services will satisfy agency requirements. The U.S. Army Corps of Engineers authorizes certain Non-Governmental Organizations (NGOs) to accept money in exchange for credits to compensate for damage to wetlands. Clean Water Act (Section 404) requires compensation for wetland impacts so as to achieve no-net loss of these natural resources.An acre of impact must be compensated for with creation of an acre of new wetlands or purchase of one credit from an NGO, which will use the funds to create wetlands. Compensation must take place in the watershed where the impact occurs or in an adjacent watershed. The Nature Conservancy which administers the Virginia Aquatic Resource Trust Fund is uniquely qualified as it is the only NGO authorized by the Corps to accept in-lieu fee credits on the Eastern Shore of Virginia watersheds. The Government does not intend to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on September 6, 2012. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. NASA Clause 1852.215-84, Ombudsman, is applicable.
