- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation (FAR) Part 6.302-2, for Other than Full and Open Competition. The US Army Contracting Command, Aberdeen Installation Contracting Division, Aberdeen Proving ground, MD 21005-3013, has a requirement to procure the following items: CLIN 0001, 1 each, Modular Room System CLIN 0002, 1 each, Inverse Multiplexer CLIN 0003, 3 each, Plasma Panel (greater than 42") The intended delivery date begins from date of the award for one year. Under the authority of FAR 6.302-1, only one responsible source and no other will satisfy the agency requirements, the Government intends to award a firm-fixed price (FFP) sole source contract to LGS Innovations LLC, 5440 Millstream Road, Room E2M31, McLeansville, North Carolina 27301. This is being sole sourced to LGS because software is proprietary LGS and they are only ones who can diagnose whether hardware and/or software issues are involved. LGS owns the software and government cannot define specific maintenance and repair parameters for proprietary software. All responses received within ten (10) days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the descretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 2:00 PM eastern time, 10 September 2012. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurement. Efforts to solicit other contractors are being made via this announcement in accordance with FAR 5.2. The anticipated cost of this acquisition is determined fair and reasonable by comparison of prices proposed in other purchases of this nature.
