- Sole Source Justification (i) This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in subpart 12.6 of the FAR and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a separate written solicitation will not be issued. (ii) Solicitation number 12-236-SOL-00038 applies, and is issued as a Request for Quote (RFQ). (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-60. (iv) The North American Industry Classification System (NAICS) code is 519130. The Indian Health Service (IHS), Division of Acquisition Policy intends to award a firm fixed price purchase order on the basis of other than full and open competition (Justification attached). (v) The Contract Line Item (CLIN) is as shown below. CLIN 0001 (Base Period - Oct 1, 2012 ~ Sep 30, 2013) - 1 year subscription to the ‘Select Plus' Emergency Care Research Institute service. (vi) The Government intends to negotiate and award an order to ECRI Institute, 5200 Butler Pike, Plymouth Meeting, PA 19462, for the subscription service that includes the information related to 1)Medical device pre-purchase evaluations & product comparison guides for health technology research and 2) Medical device alert recalls, hazards, product safety issues, problems reported regulatory analyses, & alerts tracker/management system. It is the Government's belief that ECRI is the only known option that provides extensive research, analysis, alerting system AND interface w/WebTMA to automate the identification of medical device safety and recall issues throughout IHS. Interested parties may identify their interest and capability to respond to the requirement or submit quotations. This notice of intent is not a request for competitive quotations however; all responses received within five (5) days from the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed acquisition is based upon responses to this notice and is solely for the purpose of determining whether to conduct a competitive acquisition. (vii) n/a (viii) The provision at 52.212-1, Instructions to Offerors - Commercial Items (Feb 2012), applies to this acquisition and a statement regarding any addenda to the provision (ix) 52.212-2, Evaluation - Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: The acceptability of the Technical Quotation and Price will be evaluated. (i) Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items (Apr 2012), with its offeror. (ii) FAR 52.212-4 Contract Terms and Conditions - Commercial Items (Feb 2012) applies to this acquisition.
