- The U.S. Department of Education (the Department), Office of Communications and Outreach (OCO), intends to renew annual subscription licenses from The Associated Press (1100 13th Street, NW, Washington, DC 20005) on a sole source basis in accordance with Federal Acquisition Regulation 13.106-1(b), subject to availability of FY13 funds. OCO has an immediate, continuing need to access The AP Washington Report & Daybook and the AP ALERT/Education services for a period of twelve months, from October 1, 2012 to September 30, 2013. STATEMENT OF NEED: The Associated Press is the nation's oldest, largest, and most widely cited news wire service. The services required meet the Department's need to access up-to-date and breaking news on national, state, and local levels by providing exclusive on-line access to AP's Internet, Washington Report, and Education Alert and Daybook services for approximately 100 users. The AP Daybook provides target breaking news from the 50 U.S. states and Washington, DC and can provide a full news report for each state. This service also provides first-hand coverage that supports strategic planning and keeps staff on top of developing stories; offers private, internal access to the full stream of AP's premium state coverage; delivers intelligence that can track information on the Department; and allows users to stay updated on education issues. ONLY ONE SOURCE AVAILABLE: After thorough market research that included review of product catalogs, GSA schedules and vendor websites, the Contracting Officer concluded that, while other companies may be able to provide news clipping services, only the Associated Press product is currently available in the commercial marketplace and is capable of immediately meeting the Department's needs without further development. RESPONSES TO THIS NOTICE: This posting is a notice of intent to renew (purchase) annual subscription licenses on a sole source basis in accordance with Federal Acquisition Regulation 13.106-1(b). No solicitation will be issued. This notice is not a request for competitive quotes, however, all responsible sources who believe their existing commercial-off-the-shelf product meets these requirements may submit a capability statement, proposal, or quote to Gary.Weaver@ed.gov no later than 2:00 pm on September 17, 2012. If no quotes are received by this time, the purchase order will be issued to The Associated Press without further notice. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Contracting Officer. The NAICS Code is 519110 with a size standard of $7 million. This procurement will be processed pursuant to FAR Part 12, Acquisition of Commercial Items, and FAR Part 13, Simplified Acquisition Procedures. No telephone inquiries will be accepted.
