Bids are being solicited under solicitation number 10692V0515. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. GSA Schedule Bids Only: Sellers bidding on this opportunity MUST have the items requested on an existing GSA Schedule. The Schedule must either be in the Seller's name or the Seller must be able to document its ability to act as an agent of a partner's Schedule. Sellers must not bid more than their applicable contract ceiling price, excluding the FedBid Fee, for contract-specific items. If FedBid receives notice that, due to inclusion of the FedBid Fee, the Selected Bid's line item pricing is higher than the Selected Seller's applicable published government contract pricing, the FedBid Fee will be reduced to ensure the Selected Bid's line item pricing does not exceed the Selected Seller's applicable contract pricing. This requirement is unrestricted and only qualified sellers may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2012-09-13 11:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be ARLINGTON, VA 22209 The Department of State requires the following items, Exact Match Only, to the following: LI 001, SAP Business Objects Enterprise Maintenance Maintenance & Support for: Web Intelligence Business Object Premium Bundle CPU, Quantity 1 UN; Web Intelligence Business Object Premium Bundle T/D NU, Quantity 6 UN; P/N - 7009111; Period of Performance: 9/21/2012 - 09/20/2013, 1, LT; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. A Seller may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in an effort to improve both seller access and awareness of requests and the agency's ability to gather multiple, completed, real-time bids.All responsible Sellers that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Sellers that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Failure to comply with the below terms and conditions may result in offer being determined as non-responsive. New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. Bid MUST be good for 30 calendar days after close of Buy. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Offeror must be registered in the Central Contractor Registration (CCR) database before an award can be made to them. If the offeror is not registered in the CCR, it may do so through the CCR website at http://www.ccr.gov. DOS A/LM/AQM Memorandum dated 04/23/08: GSA schedule orders may include "open market" items, i.e., items not on the awardee's list of GSA schedule items, only in compliance with FAR 8.402(f). Offerors should verify in writing which items are listed on their GSA schedule contracts and which items are "open market" items. For an offer to qualify as an offer based on a GSA schedule contract, the value of "open market" items included in the offer may not exceed the applicable micro-purchase threshold as defined in FAR 2.101. In order to notate which items are open market, in accordance with FAR 8.402(f)(3), Seller must write "open market" in the Line Item Description for any item not currently active on the cited contract, or list in the Seller Bid Description field all open market line numbers (e.g. "Open Market Items: Lines 1, 2, 3.") A) The offeror shall provide the government, with its offer submission, written verification from the GSA schedule holder that an agreement exists that validates the offeror's right to offer the GSA schedule items on behalf of the GSA schedule holder, if other than the offeror; and, B) By proactively complying with this offer term, sellers accept that the government will make award to the GSA schedule holder only, as the sole awardee. Further, the sole awardee and only the sole awardee shall submit its invoice to the government and receive payment from the government. In addition to providing pricing at www.FedBid.com for this solicitation, each Offeror must provide any required, NON-PRICING responses (e.g. technical proposal, representations and certifications, etc.) so that they are received no later than the closing date and time for this solicitation. All Bids must be valid for 30 days from the closing date for this solicitation. No exceptions or qualifications. (a) The provider of information technology shall certify applications are fully functional and operate correctly as intended on systems using the Federal Desktop Core Configuration (FDCC). This includes Internet Explorer 7 configured to operate on Windows XP and Vista (in Protected Mode on Vista). (b) The standard installation, operation, maintenance, update, and/or patching of software shall not alter the configuration settings from the approved FDCC configuration. The information technology should also use the Windows Installer Service for installation to the default ?program files? directory and should be able to silently install and uninstall. (c) Applications designed for normal end users shall run in the standard user context without elevated system administration privileges. (d) The Department of State currently intends to use Vista in Protected Mode in the future when all devices at all worldwide locations have sufficient capacity to permit an upgrade from the XP operating system. FAR 52.225-5 Trade Agreements and FAR 52.225-6 Trade Agreements Certificate will apply to the resulting order. Pursuant to the Trade Agreements Act (19 U.S.C. 2512(a)) (TAA), Federal acquisitions of supplies may be made only from offerors that will supply products of an eligible country under any of the free trade agreements entered into pursuant to the TAA. An article is considered a product of a country only if it is wholly a product of that country or if it has been ?substantially transformed? in that country into a new and different article of commerce with a name, character, or use distinct from that of the original article(s). Note that any item that is a discreet article as it is sold in commerce, regardless of its ultimate function or use, cannot be considered ?substantially transformed? based solely on its integration into IT or other systems. FAR 25.003 defines WTO GPA qualifying countries as: Aruba, Austria, Belgium, Bulgaria, Canada, Costa Rica, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Israel, Italy, Japan, Korea (Republic of), Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Oman, Peru, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, or United Kingdom. See FAR clauses listed above for full country details and restrictions. Full text of FAR clauses may be referenced at http://www.acquisition.gov/far/. The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Furthermore, no article, book, pamphlet, email, recording, broadcast, speech television appearance, film or photograph concerning any aspect of work performed under this contract shall be published or disseminated through any media without the prior written authorization of the Contracting Officer. These obligations do no cease upon the expiration or termination of this contract. The Contractor shall include the substance of this provision in all contracts of employment and in all subcontracts hereunder. All items requested are required to be on the vendor?s schedule contract as a precondition to its receiving the award order. Offers that include any items not on schedule with a total amount exceeding the micropurchase threshold at time of bid will not be considered. The Office of Acquisition Management (A/LM/AQM), Department of State (DoS), is processing this acquisition at the request of the Bureau of Diplomatic Security (DS/EX.CTO). This Justification and Approval (J&A) is for the acquisition of SAP Business Objects software products and support on a brand name only basis: Pursuant to FAR 8.405-6 (a)(2) for a limited source acquisition, the use of a brand name description is essential to the Government's requirements, thereby precluding consideration of other business intelligence software products manufactured by another company. The Department's Bureau of Diplomatic Security (DS) requires the purchase of licenses for the SAP Business Objects Business Intelligence suite and first year support. These licenses and support are required to expand the existing use of the product within DS in order to meet growing DS reporting and business intelligence requirements. This J&A supports the purchase of the SAP Business Objects Business Intelligence suite on a brand name only basis. The requirement will be competed among Business Objects (BO) resellers that have GSA Federal Schedule contracts for these software products. The Business Objects product has been in use by DS for over 8 years and is the single reporting product used by DS for all IT systems. By commonly using a single product line, DS has saved money by integrating the product with over 12 separate applications/systems and by focusing contractor and support resources on a single skill set. The reports made available through the Business Objects platform provide DS managers greater analytical ability which enhances decision-making processes, boosts operating efficiencies, and lowers operating costs. In essence the Business Objects tools have increased the value of DS's data sets and allowed the Bureau to have a forward and backward view of the data so that they may know what has happened, what is happening, and what is likely to happen. The business objects business intelligence software products and support are required by DS/EX/CTO and are developed by SAP. The business intelligence software products/support are available for purchase from SAP and SAP resellers. As this is a brand name only justification, no one contractor's unique qualifications are cited as the basis for this justification. Rather, the products/support identified by brand name herein have been determined to be the only items that maximize the Government's existing investment. These Business Objects products are essential for meeting the continuing expansion of DS reporting and business intelligence requirements. A/LM/AQM intends to compete the DS requirements among SAP resellers possessing a GSA FSS No. 70 contract. The Office of Acquisition Management has identified at least 10 such firms, some of which are small businesses. Potentially, the largest benefit to utilizing SAP Business Objects as the business intelligence tool for OS is the fact that Business Objects already has a presence at DoS and is already in use with numerous systems not just in DS, but also IRM, CA, A and HR bureaus. Therefore, there are several areas within the Department that possess institutional knowledge around the tools, and Business Objects supports their software running on VMware virtualization software, which is a large piece of the now mandatory Department infrastructure. To date, the DoS has invested significantly in Business Objects as its business intelligence technology 10 support multiple business applications, such as the Human Resource Knowledge Center (HR), Global Financial Management System (A), Enterprise Data Warehouse (IRM) and numerous Consular Affairs (CA) applications. The DoS Information Technology Change Control Board's (ITCCB) change management has already approved addition of the Business Objects Business Intelligence products to the DoS baseline. Furthermore, Business Objects approved IT CCB software suite will enable DS to continue using the software without going through the difficult and costly process of adding the software to the baseline. However, DS is aware that ITCCB approval for use within the Department does not constitute an official endorsement of the product by the Department nor does it mean that it is mandated as the business intelligence product to be used. This approval is based on the discovered common use and positive results of the SAP product as an authorized exception to full and open competition pursuant to FAR 6.302-1(b)(4). DoS users have been trained in the use of Business Objects with other system implementations. Therefore, not only is the knowledge and skill set to use the tool already present in the Department, but training materials are present as well, thereby achieving a cost savings. Additionally, as Business Objects licenses are already owned by DS this is merely an expansion of the existing investment in the product. From a development standpoint, there is also a potential to reuse the Business Objects code that has already been developed as part of other pre-existing DoS implementations thereby saving some costs. The requirement will be competed among SAP Business Objects resellers that have GSA FSS contracts. GSA has already determined the schedule prices to be fair and reasonable. However, the Government intends to competitively award a delivery order to the offeror that represents the overall the best value to the Department. Although the requirement is justified on a limited source basis, AQM will post the requirement on FedBid and will include the brand name justification with the posting as required by FAR 8.405-6(d). The requirement will be competed on FedBid among Federal Supply Schedule No. 70 contractors in compliance with FAR 8.405-6 and AQM Memorandum 08-05.
