Description
Pursuant to FAR 5.203(a), the purpose of this notice of intent is to improve small business access to acquisition information and enhance competition by identifying contracting and subcontracting opportunities and promote early exchanges of information through allowing vendors to submit capability statements addressing their ability to provide the required services during the period from 29 September 2012 through 28 September 2012, with two (2) option periods from 29 September 2013 through 28 September 2014 and 29 September 2014 through 28 September 2015. Specifically, the required services include the provision of activated standard commercial physical fitness facility gym memberships HQDA G-3/5/7 DAMO-CSF military personnel with access to state of the art cardiovascular and strength machines, free weights, and fully complimented locker rooms with showers within a fifteen (15) minute round trip walking distance of 251 18th Street, Arlington, VA 22202, as described in the Performance Work Statement (PWS) provided below. The North American Industry Classification Code (NAICS) is 713940, with a corresponding Small Business size standard of $7 Million. The Government intends to negotiate a contract with Sport and Health Clubs, L.C. of 1760 Old Meadow Road, Suite 300, McLean, VA 22102-4330 (S&HC) for the aforementioned period of performance. The contract will be issued in accordance with Federal Acquisition Regulation (FAR) Part 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items. The authority for exception to other than full and open competition is Title 10, U.S.C., Section 2304(c) (1), as implemented by the FAR 6.302-1. This exception applies when an award must be ISSUED on a sole source basis because only one responsible source and no other supplies or services will satisfy agency requirements. All responsible sources other than S&HC, may submit Capability Statements. Capability Statements shall not exceed 20 pages and are due no later than 3:00 p.m. on September 27, 2012 (EDT). Performance Work Statement (PWS) for Headquarters Department of the Army Comprehensive Soldier Fitness Gym Memberships Dated 20 September 2012 1 Scope The purpose of this document is to obtain gym memberships for the Headquarters Department of the Army G-3/5/7 Department of the Army, Military Operations-Comprehensive Soldier Fitness (HQDA G-3/5/7 DAMO-CSF) staff. The staff members need access to gym facilities that have state of the art cardiovascular machines, strength machines and free weights. The gym facility must be within a fifteen (15) minute round trip walking distance of the HQDA G-3/5/7 DAMO-CSF duty station located at Crystal Square Five, 251 18th Street South, Arlington, VA 22202. The gym facilities also must contain fully complimented locker rooms with shower services. 2 Applicable Regulations - Department of Defense Directive 1308.1 June 30, 2004 (and) -5 U.S.C 7901 Health Service Programs 3. Background Army military personnel must adhere to physical fitness standards established by the U.S. Army to be in compliance with the applicable directives provided in Paragraph II It is mandatory that enlisted members meet the Army Physical Fitness Test (APFT) requirements for continued service in the Army. As a result, in order to facilitate the continued achievement of APFT requirements military personnel are granted times within their respective tours of duty to conduct physical training. Maintaining physical fitness is not an option for military personnel but a regulatory requirement. As such, military personnel assigned to HQDA G-3/5/7 DAMO-CSF require reasonable access to a fitness center to adhere to the aforementioned directives and meet the requirements of the AFPT. Many military staff members commute via train, bus, shuttle or slug, which limits their transportation options to those three means or walking. To avoid excessive commuting times and costs the fitness location is expected to be within a 15 minute round trip walking distance of the Government facility. The use of a commercial fitness facility is required as a result of the unavailability of military fitness facilities within a close proximity of the HQDA G-3/5/7 DAMO-CSF duty station. 4 Objectives The contractor shall provide a fitness facility for military personnel assigned to the duty station at Crystal Square Five, 251 18th Street South, Arlington, VA 22202 the opportunity to maintain their physical fitness. 5 Requirements 5.1 Program Objectives The Contractor shall: Provide all supplies and services necessary for standard commercial physical fitness facility gym memberships. Provide HQDA G-3/5/7 DAMO-CSF military personnel with activated standard commercial physical fitness facility gym memberships that provide access to state of the art cardiovascular and strength machines, free weights, and fully complimented locker rooms with showers within a fifteen (15) minute round trip walking distance of 251 18th Street, Arlington, VA 22202. Ensure that the gym is available for use by HQDA G-3/5/7 DAMO-CSF military personnel within the hours from 0500 to 2100 hours Eastern Standard Time on Mondays through Fridays and within the hours from 0700 to 1800 hours Eastern Standard Time on Saturdays and Sundays, except Federal Holidays or when HQDA G-3/5/7 DAMO-CSF offices are closed due to inclement weather, local or national emergencies, administrative closings, or similar Government directed facility closings. Federal holidays are defined as: New Year's Day Martin Luther King Jr.'s Birthday President's Day Memorial Day Independence Day Labor Day Columbus Day Veteran's Day Thanksgiving Day Christmas Day The Contractor shall provide strictly non-personal services and shall work as an independent contractor not subject to supervision or control by the Government. 5.2 Memberships The Contractor shall provide fourteen (14) activated standard commercial physical fitness facility gym memberships. Eight (8) of the activated standard activated standard commercial physical fitness facility gym memberships will be fully subsidized by the Government. Six (6) of the activated standard activated standard commercial physical fitness facility gym memberships will be partially subsidized by the Government. The Government will hold the option of adding up to four (4) additional memberships (two (2) fully subsidized, (2) partially subsidized) in the case of additional military personnel being assigned to HQDA G-3/5/7 DAMO-CSF. If enrollment fees apply, this fee will be added to the total monthly fees to arrive at a total yearly evaluation price. All memberships will be provided on a contractual basis as organizational memberships and are not transferable. Individuals will hold no personal rights in the memberships separately from their employment by HQDA G-3/5/7 DAMO-CSF. Upon separation from employment or reassignment, individual memberships will be terminated. Cancellations must be made to the contractor 30 days prior to the billing date with proper documentation, which shall be the responsibility of and provided by the HQDA G-3/5/7 DAMO-CSF member. The contractor will provide information regarding the billing date to each individual upon initiation of membership. All qualified HQDA G-3/5/7 DAMO-CSF military personnel will be eligible to join at the contracted price. Participants will complete membership paperwork and acquire membership identification cards from the contractor. Any replacement fee for lost membership identification cards is the responsibility of the HQDA G-3/5/7 DAMO-CSF participant. The Government reserves the right to lower the number of memberships used depending on staffing and participation levels. 5.3 Government Furnished Assistance There will be no government furnished assistance provided under this contract. 5.4 Security None. 5.5 Inspection and Acceptance Criteria In accordance with WAWF. 5.6 Type of Contract Firm-Fixed Price. 5.7 Contracting Officer's Representative (COR) The COR for this contract will be identified by a separate action prior to award. The COR will monitor all technical aspects of the contract and will assist in contract administration. The COR is authorized to perform the following functions, if deemed necessary by the COR: (a) assure that the contractor performs the technical requirements of the contract; (b) perform inspections necessary in connection with contract performance; (c) maintain written and oral communications with the contractor concerning technical aspects of the contract; (d) issue written interpretations of technical requirements; and, (e) monitor contractor's performance and notifies both the contracting officer and contractor of any deficiencies. A letter of designation will be issued to the COR, a copy of which will be provided to the contractor. The letter will define the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resultant contract. 5.8 Identification of Contractor Employees Not required. 5.9 Contractor Travel None required 5.10 Reports The contractor will provide the Contracting Officer's Representative with an updated membership list at the beginning of this agreement and on a monthly basis. Membership list and invoices shall be sent to the COR via e-mail and Wide Area Work Flow (WAWF). The contractor will be authorized to invoice and receive payment for monthly membership fees. Monthly fees will be invoiced in two categories: fully subsidized memberships for all military personnel with a rank of O-3 and below and partially subsidized memberships for all military personnel with a rank of O-4 and above. For fully subsidized memberships the contractor will bill for the full membership price. For partially subsidized memberships the contractor will bill for the full membership price minus the service member's portion of $22.09 per month. Those with subsidized memberships will be responsible for paying the $22.09 portion themselves. The contractor will be authorized to invoice and receive payment for monthly membership fees as previously stated for each participant upon the processing and issuance of the Fitness Center's Membership Cards to eligible HQDA G-3/5/7 DAMO-CSF military personnel. A total membership fee for membership is defined as one offered to the general public for a set fee with no extras. Items which will not be included in the full membership fee are defined as extra classes, personal trainers, lockers (if not included in the full membership fee), and the like. If enrollment fees apply, this fee will be added to the total monthly fees to arrive at a total yearly evaluation price. Any enrollment fee, if applicable, shall be apportioned by month and absorbed into the monthly fee for the purposes of monthly invoicing through the government's WAWF system, a system which is described in the solicitation at clause 252.232-7003. 6 Administrative 6.1 Period of Performance The period of performance shall be for one (1) base year (12 month period) and two (2) option years (12 month periods). This PWS shall be in operation for a base year period 29 September 2012 through 28 September 2012. The two (2) option periods are from 29 September 2013 through 28 September 2014 and 29 September 2014 through 28 September 2015. The Government reserves the right to extend the term of this contract in accordance with the terms and conditions contained in Federal Acquisition Regulation clause 52.217-9 entitled, "Option to Extend the Term of the Contract." 6.2 Place of Performance All fitness activities will be performed at the Contractor's facility.
