Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the Acquisition Service, Frederick, MD, on behalf of the Department of Veterans Affairs (VA), Office of Policy and Planning (OPP). 2. Nature/Description of Action. This activity proposes to negotiate a noncompetitive award (sole source) with ReefPoint Group, LLC, a Service-Disabled Veteran Owned Small Business (SDVOSB), for the procurement of services to establish a Program Management Center of Excellence (PMCOE). 3. Description of Supplies/Services. The VA has recognized that to increase the effectiveness and efficiency of its acquisition program and projects, and to meet the ever increasing integration of programs across the VA, the provisioning of an enterprise-level PMCOE is crucial and the need is immediate. Access to program management proven best practices, processes, standards, guidelines, templates, tools, standard approved training, and experts will be available to, and used by, program management professionals across the VA. Products and services offered by the PMCOE must be regarded as best that VA can provide and be viewed by the program management professionals as valuable in assisting them to deliver programs on time, on scope, and on cost. The mission of the PMCOE is to enhance the probability of success of VA's acquisition programs and projects by providing proven program management intellectual capital, training, and subject matter experts to program managers, program management offices, and assigned staff. The PMCOE will not serve as a program management office overseeing programs, and will not directly manage acquisition programs. The PMCOE will identify and create standard, repeatable acquisition program management capabilities across the Department in accordance with the Acquisition Program Management Life Cycle Framework (APMLCF). These capabilities (often referred to as disciplines) include, but are not limited to, program management, contract management, risk management, quality control, resource management (people), financial management, cost analysis and life cycle cost estimation, schedule management, requirements engineering and management, test and evaluation, systems engineering, and accessibility. The PMCOE will ensure alignment with the APMLCF and will facilitate communication, applicability, and utilization of best practices across the Department. The proposed total contract cost for the base year and two option years is estimated to be $1,717,690.52; Base Year: $805,691.64; Option Year One: $453,171.68; Option Year Two: $458,827.20. 4. Identification of Statutory Authority. The statutory exception permitting other than full and open competition for this acquisition is 41 U.S.C. § 253(c)(5), Authorized or Required by Statute, as implemented by FAR 6.302-5. The applicable statute is PL 109-461, Veterans First Contracting Program (codified at 38 U.S.C. § § 8127 and 8128). 5. Demonstration of Contractor's Unique Qualifications. ReefPoint Group, LLC, is an SDVOSB verified in Vet Biz.gov. ReefPoint Group, LLC exhibits noted strength in the required Program Management Center of Excellence (PMCOE) discipline areas: Requirements, Systems Engineering, Cost Estimation, Risk, Planning, and Scheduling. The company demonstrates tangible past experience in performing the requisite subordinate tasks associated with each of these focus areas, as well as the capability to dedicate qualified resources (personnel) to conduct these business processes. ReefPoint's program management acumen is anticipated to be instrumental in developing the VA's PMCOE Operating Model and aligning it to the APMLCF. The company also exhibited a great deal of potential to provide a Communications Plan to engage and create buy-in from program stakeholders, a Risk Management Plan to identify, analyze, and mitigate program risks, and a robust Operating Plan centered around a Work Breakdown Structure. The company also demonstrated the capability to pursue actionable objectives, offer training to Program Managers, and create an enterprise strategy to set the PMCOE on a path for success. ReefPoint will be determined responsible in accordance with FAR 9.104-1 prior to award. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. A notice of intent will be published in the Federal Business Opportunities system. 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the price to the Government to be fair and reasonable. This determination will be based on a comparison of the offeror's price proposal to the Government estimate, which is based on an average of rates from GSA schedule holders under an existing VA multiple-award contract. 8. Description of Market Survey. Market research was conducted to form a list capable vendors. Several vendors were contacted via e-mail regarding the potential requirements of PMCOE and the vendor's capabilities that were compatible with this effort. The vendors were requested to participate in further market research by meeting with the PMCOE management team and discussing their capabilities, experience and expertise in relation to the potential effort to be performed. 9. Other facts supporting the use of other than full and open competition. In accordance with VAAR 819.7007(b), the contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. 10. Listing of Interested Sources. Not applicable. 11. Actions Taken to Remove Barriers to Competition. All future requirements will be handled on a case-by-case basis. ?
