- JUSTIFICATION AND APPROVAL DOCUMENT FOR A LIMITED SOURCE AWARD UNDER A FEDERAL SUPPLY SCHEDULE 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: This proposed action is for a one-year, firm-fixed-price task order that will be issued under the General Services Administration (GSA) Federal Supply Schedule (FSS) Schedule 70, for International Business Machines (IBM) z/Operating System (OS) for software maintenance and lifecycle extension renewals for the Hines, Illinois and Philadelphia, Pennsylvania Information Technology Centers (ITCs). 3. Description of the Supplies or Services: The proposed action will provide twelve months of software maintenance renewals for the IBM z/OS 390 software products installed on the Hines, Illinois and Philadelphia, Pennsylvania ITCs IBM mainframe systems. Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106 (c) as implemented by the Federal Acquisition Regulation (FAR) Subpart Part 8.405-6(a)(1)(i)(B) entitled, "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: The proposed source is IBM Corporation, 6710 Rockledge Drive, Bethesda, Maryland 20817. The required IBM z/OS software is wholly owned and licensed by IBM and is proprietary to IBM. Hines and Philadelphia ITC's mainframe systems will not function without the aforementioned software. Hines IBM mainframe system processes the Benefits Delivery Network (BDN) batch processing payment system supporting all compensation and pension, education and vocational rehabilitation applications for the nation's Veterans and their dependents. Philadelphia IBM mainframe system processes the Veterans Benefit Administration (VBA) Insurance System benefits and applications for the nation's Veterans and their dependents. The majority of the BDN system and Insurance system application programs have been written to support the IBM software code and routines. Therefore, it would require a major rewrite of software codes in order to process applications using a source other than IBM. 6. Efforts to Obtain Competition: In accordance with FAR 5.301 and 8.405-6(a)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other solutions can be considered. 8. Market Research: The required software is wholly owned and proprietary to IBM. To confirm that there are no value added resellers (VARs) for this software, market research was conducted utilizing the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurements (SEWP) IV Government-Wide Acquisition Contract (GWAC) by posting Request for Information (RFI) #139927 to determine if any vendors could provide the required software maintenance. The RFI yielded no responses. Further search of NASA SEWP Product Verification Tool confirmed there are no VARs capable of providing the required software maintenance. 9. Other Facts: The Philadelphia Insurance System and Hines BDN System IBM mainframe platforms are partitioned to allow dedicated processing for backup and disaster recovery processing. Therefore, both platforms must keep the same core Z/OS 390 software operating levels to support these VA mission critical payment systems. If the software version levels are not in sync, the annual disaster recovery exercises will not execute and the Veterans Benefits Administration (VBA) will not have backup recovery systems in place. It is critical to provide the latest Z/OS 390 version levels, patches and fixes that are released from the original equipment manufacturer (OEM), IBM, for the mainframe systems located at Hines and Philadelphia ITCs.
