Description
JUSTIFICATION AND APPROVAL DOCUMENT FOR A LIMITED SOURCE AWARD UNDER A FEDERAL SUPPLY SCHEDULE 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition and Logistics Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for the renewal of two (2) software license keys and maintenance support which are installed on the International Business Machines (IBM) mainframe systems, Model 2098-B03 z/10 at the Veteran Benefits Administration (VBA), in Philadelphia, Pennsylvania and Hines, Illinois Information Technology Centers (ITC's). The total period of performance for this effort will be 12 months with one (1) 12-month option period. 3. Description of Service and Supplies: The purpose of this action is to procure two (2) software license keys and maintenance support from Levi, Ray, & Shoup, Inc. The annual license keys provided by Levi, Ray, & Shoup, Inc enable the VA ITC Systems Administrators authorization to download updates to the existing products described below. The vendor maintenance support provides email, telephone, and website assistance and software updates. Each software license key consists of the following: "Virtual Telecommunications Access Method (VTAM): Generates remote mainframe printing support to individual's desktop computer. "Virtual Printer Support/Transmission Control Protocol Internet Protocol (VPS/TCPIP): Generates mainframe printing from the IBM Job Entry Subsystem 3 (JES3) software to network printers and large scale impact printers. These software products have been utilized on the Hines IBM mainframe system and supports the VBA Benefits Delivery Network (BDN) Payment System which operates under the IBM Z operating systems. The Philadelphia IBM mainframe system processes the VBA Insurance System benefits and applications for the nation's Veterans and their dependents. This software runs on the IBM Z operating system and is essential in supporting print functions for insurance processing applications. The Insurance Payment System disburses over $1.5 billion in entitlements and generates five (5) million pieces of mail annually. The total estimated price of the proposed action is 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106 (c) as implemented by the Federal Acquisition Regulation (FAR) Subpart Part 8.405-6(a)(1)(i)(B) entitled, "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 5. Reason for Authority Cited: The proposed source for this action is Levi, Ray & Shoup Inc, 2401 W Monroe ST, Springfield, Illinois 62704. VBA has utilized these software licenses to support the BDN IBM batch-processing and the on-line insurance payment system applications. The majority of the VBA BDN and insurance applications have been written to support the software code and routines these products utilize. Therefore, it would require a major rewrite of these software codes in order to process using any other vendor's product. Only Levi, Ray and Shoup, Inc is an authorized reseller for these software license keys and maintenance support which are wholly owned and proprietary to IBM. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. There is no competition anticipated for this action. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be completed. 8. Market Research: The Government's technical experts conducted market research in May 2012 and determined the aforementioned software provided by Levi, Ray, & Shoup, Inc was not available on National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC). Additional market research was conducted in May 2012 by using General Services Administration (GSA) Federal Business Opportunities Advantage website to review vendors which are licensed to sell software license keys. The existing software is currently installed on two IBM mainframe systems (Model 2098-B03) supporting VBA Veteran's entitlement programs, the BDN Payment System and the Insurance Payment system. Based on the planned IT initiative to replace the functionality of the current BDN legacy applications to open client server, it would not be cost effective to acquire a replacement third party product to mirror the functionality of the IBM software license keys. The existing software license keys and maintenance support is wholly owned and is proprietary to IBM. Levi, Ray, and Shoup, Inc is the only authorized reseller for these software license keys and maintenance support. 9. Other Facts: A Purchase Order was issued to Levi, Ray & Shoup, Inc for software license keys and maintenance under Purchase Order Number VA-118-11-F-0004 on October 1, 2011.
