- RECOVERY Funded by the American Recovery and Reinvestment Act of 2009 Pre-Solicitation Notice Project Title : Program and Technical Services in Support of Department of Commerce (DOC) Office of Inspector General's (OIG) Audits and Oversights of the National Telecommunications and Information Administration's (NTIA), Broadband Technology Opportunities Program (BTOP) THIS PROJECT WILL BE FUNDED BY THE AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009. This pre-solicitation notice is hereby issued in accordance with the requirements of the Federal Acquisition Regulation (FAR) Subpart 5.704. This pre-solicitation notice is for the same requirement as was detailed in the Sources Sought Notice Reference No. GG000000-12-04019. However, changes may have been made to the requirement since the posting of the Sources Sought Notice. Whether or not a company responded to the Sources Sought Notice has no bearing on their eligibility to respond to the forthcoming solicitation. The American Recovery and Reinvestment Act of 2009, Pub. L. No. 111-5, directed the National Telecommunications and Information Administration (NTIA) of the Department of Commerce to create the Broadband Technology Opportunities Program (BTOP), a matching grant program to expand broadband access to unserved and underserved areas of the United States. The Recovery Act authorized BTOP $4.7 billion that resulted in $3.9 billion for 121 infrastructure grants, 65 public computing center grants, and 43 sustainable broadband adoption grants, as of September 30, 2011. NTIA awarded the approximately 230 BTOP grant awards worth about $3.9 billion to a variety of recipients that include public entities, for-profits, nonprofits, and tribal entities. Awards were made in three major areas: program infrastructure, public computer centers, and sustainable broadband adoption. Awards went to each of the states, the District of Columbia, Guam, Puerto Rico, and the U.S. Virgin Islands. The projects are required to be completed in three years with all awards scheduled for completion by September 30, 2013. Also, the Recovery Act required NTIA to transfer $10 million of BTOP funds to the Office of Inspector General for audits and oversight of BTOP grants. A $302 million rescission occurred in August 2010 pursuant to Pub. L. No. 111-226, reducing the total funding from $4.7 million to around $4.4 million. The remaining funds went to develop and update a publicly searchable National Broadband Map, administrative expenses, and transfers to the Federal Communications Commission for the development of the nation broadband plan. The purpose of this requirement is for a contractor to assist the OIG in conducting audits and oversight into programs and operations of the NTIA's Broadband Technology Opportunities Program. The OIG keeps the Secretary, Deputy Secretary, and Congress informed of serious problems and deficiencies relating to the administration of the Department's programs and operations, recommends corrective actions, and reports on the progress made in implementing corrective actions. The contractor will be responsible for both performance and financial audits. The NAICS code for this requirement is 541219 with a small business size standard of $8.5 million. Contracting by Negotiation shall be utilized under the authority of FAR Part 15. This requirement will be 100% set-aside for small business. A firm-fixed price contract is anticipated. The competitive Request for Proposal (RFP), amendments, and all questions and answers related to this procurement shall be made available via the Internet at HTTP://WWW.FEDBIZOPPS.GOV under RFP number SB1304-13-RP-0002. Potential offerors shall be responsible for obtaining this solicitation and related Amendments, if any, from www.fbo.gov after the solicitation has been posted. It is, and will continue to be, the responsibility of each potential Offeror to monitor www.fbo.gov for any amendments or other information related to the solicitation. The Government will not maintain a mailing list. Any communication regarding this requirement must be made in writing and forwarded via email to keith.bubar@nist.gov, and shall identify the solicitation number, company name, company address, as well as point of contact email address and phone number. Offerors shall be actively registered in the System for Award Management website at www.sam.gov, in order to be eligible to receive a contract under this solicitation. NIST anticipates posting the solicitation approximately 15 days after the date of publication of this notice.
