- Description of Action: The proposed sole source action is for the procurement of 50 annual term licenses for the Reasonable Accommodations Compliance System (RACS) supporting VA Central Office, Human Resources and Administration (HRA). The procurement is proposed to be awarded as a firm-fixed price delivery order under the General Services Administration (GSA) Federal Supply Schedule (FSS) GS-35F-0240P to MicroPact Engineering Inc. (MicroPact). Description of Supplies or Services: Entellitrak is the only software that, without major modification, can meet the need required by this contract. The software components were programmed as such to have adaptability to future requirements, or to changes in laws and regulations, without the need for program changes to the source code. The Equal Employment Opportunity Commission (EEOC) has established specific guidance for the processing of requests for accommodation. This guidance includes annual reporting to the EEOC. It is the only software which fully supports this EEOC guidance and reporting requirement. Further, it is the only known software that meets Section 508 accessibility requirements, as described in the Section 508 Amendment to the Rehabilitation Act of 1973. Section 508 requires that all IT be accessible to people who have disabilities. Most of the 508 specifications are for making IT accessible for people who are blind or have low vision. 508 also requires that any software the VA acquires be compatible with the assistive IT that is already being used by VA employees with disabilities. MicroPact is the developer of Entellitrak software and has not authorized the software to be sold through any other sources outside of their company. Authority: Federal Acquisition Regulation (FAR) Subpart 8.405-6(a)(1)(i)(B) entitled, "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." VA currently uses licenses acquired from MicroPact. The licenses were used to test whether the module could provide the required output within RACS. The tests confirmed the Entellitrak software satisfies VA's need. The research found no other available solution that would enable compatibility within the existing RACS architecture without extensive modification and further refinement to the existing system. Based on this market research, the Government's technical experts determined that only Entellitrak software can meet all of VA's needs.
