- Early Disclosure of COI-related provisions and clauses The United States Environmental Protection Agency's (EPA) Region 8 Contracting Office intends to issue a Request for Proposal (RFP) to provide Emergency and Rapid Response Services (ERRS) to EPA Region 8 which consists of the states of Colorado, Wyoming, Montana, Utah, North Dakota, South Dakota, and Tribal Nations. The solicitation number for this acquisition will be SOL-R8-12-00003, and the anticipated release date is November 2, 2012. The requirement will be to provide cleanup services as specified in task orders for emergency and time critical removal actions, which include the release or threat of release of oil, petroleum products, hazardous substances, or pollutants and contaminants that pose an actual or potential threat to human health or welfare, or to the environment. Environmental cleanup/response to natural and manmade disasters, terrorist activities, weapons of mass destruction, and nuclear, biological or chemical incidents may also be required under this contract. It is the Government's intent to award one seven (7) year, Fixed-Rate Indefinite Delivery/Indefinite Quantity contract, with work ordered through the issuance of task orders on a time-and-materials basis. The fixed rates will be applicable to all labor and equipment (prime and subcontractors). The anticipated period of performance consists of a two (2) year base period, two (2) two-year option periods, and one (1) one-year option period for a total maximum potential period of performance of seven (7) years. The acquisition will be a total Small Business Set-Aside negotiated in accordance with FAR Part 15 procedures. The applicable NAICS code to determine small business qualifications for this requirement is 562910, Environmental Remediation Services. The successful contractor must be technically qualified to undertake response actions relative to section 104 of the "Comprehensive Environmental Response, Compensation and Liability Act of 1980" (CERCLA) as amended by "Superfund Amendments and Reauthorization Act of 1986" (SARA), Subtitle I of the "Resource Conservation and Recovery Act" (RCRA) as amended by SARA of 1986, the "Clean Water Act" as amended by the "Oil Pollution Act of 1990." The contractor may also be tasked to support EPA's role under the "National Response Plan" (NRP) in instances of presidential-declared disasters pursuant to the "Robert T. Stafford Disaster Relief and Emergency Assistance Act" (Stafford Act). There are conflict of interest (COI) limitations associated with this acquisition. Potential offerors are advised that current Superfund Technical Assessment and Response Team (START) contractors or team subcontractor in Region 8 will be ineligible for award of this contract due to Conflict of Interest concerns. Please see the Early COI Disclosure attachment to this notice for more information. The purpose of this notice is to notify potential offerors of EPA's forthcoming requirement. This notice, the RFP, amendments and other information related to this procurement will be posted on www.fbo.gov.
