Description
The Department of Veterans Affairs (VA), Office of Research and Development, Technology Transfer Program intends to solicit a commercial requirement for its new legal and litigation services. It is contemplated that this will be a multiple award IDIQ contract set aside for SDVOSB's and VOSB's; the government however reserves the right to make the final determination based on the number, type, and quality of proposals received. The Office of Research and Development (ORD) is the research arm of the Veterans Health Administration (VHA). The major emphasis of ORD is to advance VA medical research and development programs that address veterans' needs, with an emphasis on service-connected injuries and illnesses, and that contribute to the Nation's knowledge of disease and disability. A secondary benefit of these research endeavors is the transfer to the healthcare delivery system of new and beneficial technologies resulting from research conducted throughout the VA medical centers. Through its Technology Transfer Program (TTP) ORD facilitates the translation of VA discoveries into practice. TTP educates inventors on the process of translating discoveries into commercial products while facilitating disclosure of discoveries/ inventions, evaluates inventions, obtains patents, fosters CRADAs (Cooperative R&D Agreements), and facilitates the commercialization of these discoveries/ inventions. TTP is committed to the timely processing of invention disclosures and all subsequent actions required for bringing VA technologies to the marketplace. TTP receives approximately 300 disclosures per year. Because of VA's historic close working relationship with affiliated academic medical centers, most of VA's inventions are jointly owned with our affiliates, who often take the lead in patenting and commercialization. This is facilitated by Cooperative Technology Administration Agreements that VA has entered into with over 60 leading affiliated academic medical centers. TTP directly manages about 20% of the disclosed inventions. The remainder are managed by our affiliates. TTP alone files approximately 30 patent applications each year, and receive approximately 5 issued patents. To date, VA or its affiliates have entered into over 200 licenses with companies to further develop VA owned inventions. The VA has ownership of inventions discovered by VA investigators. These inventions require protection by patents which are costly to file, prosecute and maintain, and require professional expertise. These VA intellectual properties (IP) will only be protected by patents. Patent protection is critical in differentiating between products and also leads to licensing specific technologies. This contract will provide the patent services required by TTP to protect VA owned intellectual property through patent filling and prosecution. These services will assist the VA TTP in developing and commercializing products that will ultimately be made available to veterans and the public. The VA TTP requires support to patent technologies invented within the VA. The requirement may include a base year and four one-year option periods for a total of five years. More detailed information will be found in the solicitation document to include a detailed statement of work and other supporting documentation. The anticipated release date of the solicitation is late November 2012.
