Description
The Department of Homeland Security, Transportation Security Administration (TSA) intends to negotiate a sole source contract with Cunning Running Software, Incorporated - 9732 Thorn Bush Drive, Fairfax Station, Virginia, 22039-2537, in accordance with FAR 6.302-1, for an extended maintenance Agreement of the type already in use as part of the TSA Contract HSTS02-07-D-SSA002. This notice of intent does not constitute a Request for Proposal. The Transportation Security Administration (TSA) has been charged with the responsibility of securing our nation's transportation systems. In turn, TSA's Office of Security Assessments [OSA] is tasked with securing the aviation community against the use of Manned Portable Air Defense Systems (MANPADS) against commercial aviation. Common examples of MANPADS are Mortars, Rifles and Rocket-Propelled Grenade Launchers. The Homeland Security Presidential Directives 5 and 7, the Aviation Transportation Security Act of 2001 (ATSA), and the Intelligence Reform and Terrorism Prevention Act 0f 2004 require TSA to conduct MANPADS assessments at high risk airports throughout the U.S. In order to fully and successfully conduct risk assessments, the OSA purchased proprietary software developed by Cunning-Running Software, LTD of Great Britain (parent company of US-based Cunning-Running Software, Inc.)under TSA Contract No HSTS02-07-D-SSA002. The Software is fully capable of calculating the probability of a successful MANPADS attack from a given location using all available data (type of MANPADS, location, terrain, visibility, etc.). During the past 5 years, TSA has purchased from Cunning-Running Software, Incorporated, software licensing; TSA owns the software. The purchase of additional software and licensing is neither required nor anticipated. This sole source effort procures a fixed-price, 3-year maintenance agreement only for software maintenance and support of the proprietary software owned by the Agency. This notice of intent is not a request for competitive proposals. However, all responses received within thirty [30] days of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract is solely within the discretion of the Government, who, in this case, previously purchased the required software. Any information received will therefore be considered solely for the purpose of determining whether to conduct a competitive procurement.
