Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Salem Medical Center by means other than full and open competition in response to procurement requests 658-13-1-5076-0016 and 658-13-1-5076-0017. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open completion for the procurement a service contract for Thin Prep and Cellient Automated Cell Block System. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Salem VAMC requires yearly maintenance contracts for their ThinPrep and Cellient analyzers. The total cost is $54,500. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.302. ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Hologic is the manufacturer of both instruments and does not authorize third parties to perform maintenance or repairs. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice was posted to FedBizOps and only Hologic responded. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Yearly pricing was found to be equal to that offered to other VA Medical Facilities, reference contracts VA251-P-1073, VA249-12-P-0857, VA667-C90056. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A sources sought notice was posted to FBO and Hologic was the only company that responded. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If Hologic begins to certify and authorize third parties to repair the instruments, a competitive solicitation will be issued. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.
