- Please freview the entire solicitation and fill out the necessary information to include signing the solicitation along with your proposal. Other Than Full and Open Competition. The Air Force plans to procure CLIN: 0001 one each Infiniium DSO - 4 GHz, 10/20 Gsa/s, 4 Ch Standard Hard Drive-installed P/N: DS09404A No substitutions allowed for this requirement; CLIN: 0002 one each R-51B-001-3C Return to Agilent Warranty - 3 Years No substitutions allowed for this requirement; CLIN: 0003 one each R-50C-011-3 Agilent Calibration - 3 years No substitutions allowed for this requirement. The Government does not own the data rights to the data or software code and cannot reproduce the Infiniium Oscilloscope. The Infinium Oscilloscope is a proprietary product of Agilent Technologies and no other company has the data rights to sell the Infiniium Oscilloscope. Contractor must be an authorized Agilent Technologies distributor; verification will be made with the company. AUTHORITY: 10 U.S.C. 2304 (C)(1), JUSTIFICATION: SUPPLIES REQUIRED ARE FROM ONLY ONE OR A LIMITED NUMBER OF RESPONSIBLE SOURCE(S) AND NO OTHER TYPE OF SUPPLIES WILL SATISFY AGENCY REQUIREMENTS. THE PROPOSED CONTRACT ACTION IS FOR SUPPLIES AND SERVICES FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE WITH ONLY ONE, OR A LIMITED NUMBER OF SOURCES UNDER THE AUTHORITY OF FAR 6.301-1. INTERESTED PERSONS MAY IDENTIFY THEIR INTEREST AND CAPABILITY TO RESPOND TO THE REQUIREMENT OR SUBMIT PROPOSALS. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. HOWEVER, ALL PROPOSALS RECEIVED PRIOR TO THE CLOSING DATE ON THE SOLICITATION WILL BE CONSIDERED BY THE GOVERNMENT. A DETEMINATION BY THE GOVERNMENT NOT TO COMPETE THIS PROPOSED CONTRACT BASED UPON RESPONSES TO THIS NOTICE IS SOLEY WITHIN THE DISCRETION OF THE GOVERNMENT. INFORMATION RECEIVED WILL NORMALY BE CONSIDERED SOLEY FOR THE PURPOSE OF DETERMINING WHETHER TO CONDUCT A COMPETITIVE PROCUREMENT. SPECIFICATIONS, PLANS, OR DRAWING RELATING TO THE PROCUREMENT DESCRIBED ARE INCOMPLETE OR NOT AVAILABLE AND CANNOT BE FURNISHED BY THE GOVERNMENT. THE GOVERNMENT DOES NOT OWN THE DATA OR RIGHTS TO THE DATA NEEDED TO PURCHASE THIS ITEM FROM ADDITIONAL SOURCES. The solicitation will be issued on 19 December 2012. The Offer Due Date is 07 January 2013, 10:00 AM MST. The entire solicitation will be made available only on FedBizOpps (FBO) website at: http://www.fbo.gov.
