Description
US Customs and Border Protection (CBP) intends to negotiate a FFP contract on a sole source basis under authority of FAR 13.106-1(b)(1) with Smiths Detection, 60A Columbia Road; Morristown, NJ 07960 for repair of an IonScan DT500, currently in use at CBP's Soutwest Regional Science Center in Houston, TX. This laboratory equipment was purchased from Smith Detection, the only manufacturer of this make/model laboratory instrument. The portable, battery-operated, hand held trace detector for explosives and narcotics is used by laboratory personnel at different ports of entry and satellite laboratories within CBP's support geographical region. This equipment is also used during mobile laboratory operations. The equipment repairs have to be done by the manufacturer. If repairs are done by an unauthorized vendor there could be liabilities issued involved regarding the scientific data and decisions generated by the equipment. For example if the instrument results state that there is cocaine present and CBP processes this case in court, the data has to be accurate per the instrument limitation and based on the software logarithms designed by the manufacturer. Repair by an outside vendor could also affect product warranties. The North American Industry Classification System (NAICS) code for this acquisition is 334511 - SEARCH, DETECTION, NAVIGATION, GUIDANCE, AERONAUTICAL, AND NAUTICAL SYSTEM AND INSTRUMENT MANUFACTURING. The Government intends to solicit and negotiate directly with Smiths Detection. No solicitation package will be issued. This notice of intent is not a request for competitive proposal. An award shall be made to Smiths Detection. The anticipated award date is 07 March 2013.
