- This is a combined/synopsis/solicitation Notice of Intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NIAID-NOI13-D1625362 and the solicitation is being issued as a Notice of Intent on a sole source basis. This solicitation document and its incorporated provisions are those in effect through the Federal Acquisition Circular (FAC 2005-66) dated February 28, 2013. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a Small Business Set-Aside. North American Industry Classification System (NAICS) code for this requirement is 334516; which has a business size standard of $25.0 mil. This requirement is for a (1) one year preventative maintenance renewal agreement on (4) four pieces of equipment, 494CLC Procise Sequencer #100000015AB, 491/491C Procise Sequencer#1P000053, 494/494C Procise Sequencer#9409169J, and 491CLC Procise Sequencer #100000035. Life Technologies, 850 Lincoln Center Drive, Foster City, CA, 94404.The purpose of this renewal is to provide uninterrupted service on these instruments covered under this contract. This is the only vendor that has trained and certified personnel to service these procise sequencers. At this time no other known vender can perform the required services on these instruments. Continuation of these sole-source service contracts are required to maintain proper functioning of our Procise protein sequencers. Award will be based on 1) technical capabilities to meet the required specifications; and 2) Price. The FAR provisions and clauses that apply to this acquisition are: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR Clause 52.212- 2, Evaluation-Commercial Items FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52.212-4, CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items; FAR 52.225-1, Buy American Act-Supplies; FAR 52.204-7, Central Contractor Registration; and FAR 32.703-2, Availability of Funds, FAR 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award.] This is not a request for competitive proposal. Offers must be submitted no later than 3:00 P.M. Eastern Standard Time on Friday, April 5, 2013.
