- Brand Name Justification SF 18 #DTPH56-13-Q-000006 NOTICE/SYNOPSIS 1. SOLICITATION: 1.1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quote/proposals are being requested and a written solicitation will not be issued. 1.2 This solicitation #DTPH56-13-Q-000006 is issued as a Request For Quotation (RFQ). This is a Brand Name requirement for PDFTron software licenses and annual maintenance and support as described in the attached RFQ. The Brand Name Justification is attached to the RFQ. 1.3 The solicitation/request for quotation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66, Effective 28 Feb 2013. 1.4 This requirement is not a small business set-aside based on the associated NAICS Code; (1) 511210 - Software Publishers, SBA size standard $25M; and (2) 423430 - Software Merchant Wholesalers, SBA size standard 100 employees 1.5 See the attached RFQ #DTPH56-13-Q-000006 for the contract line item descriptions, clauses and provisions, and additional information. 1.6 The Pipeline and Hazardous Materials Safety Administration (PHMSA) is seeking quotes for a software development toolkit (SDK) for viewing, annotation, creation, and manipulation of PDF documents on mobile (iOS) applications. 1.7 DATES AND DELIVERY LOCATION AND ACCEPTANCE: The date of delivery is 20 days after the effective date of award. Delivery Location is as follows: US Department of Transportation Pipeline and Hazardous Materials Safety Administration (PHMSA) 1200 New Jersey Ave. SE Washington, DC 20590 2. CONTRACT TYPE AND AWARD: As a result of this solicitation, PHMSA intends to issue a Firm-Fixed Price Purchase Order in accordance to FAR 13. As authorized in FAR 13.106-1(e) Use of Options, PHMSA is requesting pricing on Option Periods. Award will be made to the Lowest Price Technically Acceptable (LPTA) offeror. The provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Offerors are advised to include a completed copy of the provision 52.212-3, Offeror Representations and Certifications- Commercial Items, with its quote. The clause 52.212-4, Contract Terms and Conditions- Commercial Items, applies to this acquisition. The clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders Commercial Items, and the additional FAR clauses cited in the clause are applicable to the acquisition. 3. QUOTE/PROPOSAL PACKAGE The quote/proposal package must contain the following: 1. Signed SF 18 form. 2. Signed Amendments, if any are issued. 3. A cover page with the offeror's Tax Identification Number, DUNS, and proposal date clearly indicated. 4. Pricing - Will be evaluated for price reasonableness. In the absence of adequate price competition, PHMSA may also use the IGCE when making a determination of price reasonableness. Proposals must be submitted electronically in PDF format to Mr. Fazal Mirza at fazal.mirza@dot.gov. Emails should reference Request for Quotation (RFQ) solicitation number DTPH56-13-Q-000006 and the company name in the subject line. 4. CONTRACTOR RESPONSIBILITY DETERMINATION To be eligible for award, the Contracting Officer must determine that the Contractor is responsible according to the standards of FAR 9.1, "Responsible Prospective Contractors." Prior to issuing any award, PHMSA will review FAPIIS information to ensure that the prospective awardee is not excluded from federal procurement and is current on all federal taxes. PHMSA will also consider a Contractor's termination history when determining contractor responsibility. 6.
