- B.2 PERFORMANCE WORK STATEMENT-MEDICAL WASTE REMOVAL 1.0. INTRODUCTION 1.1. BACKGROUND The Veterans Health Administration (VHA) is the Nation's largest integrated health care system. With a medical care appropriation of more than $47 billion, VHA employs more than 239,000 staff at over 1,400 sites, including hospitals, clinics, nursing homes, domiciliary occupancies, and Readjustment Counseling Centers. In addition, VHA is the Nation's largest provider of graduate medical education and a major contributor to medical research. The mission of the VHA is to honor America's Veterans by providing exceptional health care that improves their health and well-being. 2.0. SCOPE OF WORK The Contractor will provide labor, transportation, collection, removal, treatment and destruction for the disposal of all Regulated Medical Waste generated by VA Montana Health Care System (VAMTHCS), VA Eastern Colorado Healthcare System (VAECHCS), VA Sheridan Medical Center (VASHE), Cheyenne Veterans Affairs Medical Center (CVAMC) and all associated Community Based Outpatient Clinics (CBOCs) and Primary Care Tele-Outreach Clinics (PCTOCs) as specified in this Performance Work Statement (PWS) and Cost/Price. Performance will be according to the requirements contained in this PWS. All facilities will be responsible for properly and lawfully packaging and storing the Regulated Medical Waste. All facilities shall store the Regulated Medical Waste in containers supplied and approved by the Contactor. Infectious medical waste containers shall be leak proof, have tight-fitting covers, and be kept clean and in good repair. The storage of Regulated Medical Waste shall be confined to an area on the premises to which only authorized personnel shall have access. All work shall be accomplished in accordance with Federal, State, and local regulations. The applicable federal regulations that are included but not limited to are the following: 1.Blood borne Pathogen Standard (OSHA), 29 CFR 1910.1030 2.Hazard Communication Standard (OSHA), 29 CFR 1910.1200 3.Infectious Waste Montana Annotated Code (MCA), 75-10-1005 (for facilities located in Montana) The Contractor shall provide the services enumerated above at the rates set forth which includes all applicable taxes, assessments, and related charges, including adjustments for it. The Contractor will provide all the necessary equipment to perform such services and all such equipment shall comply with all applicable federal, state, county, and municipal laws, regulations, guidelines and permits. The Contractor is fully responsible for destruction and disposal of all Regulated Medical Waste (bio-hazardous) and Chemotherapy Waste generated by the facilities. All Regulated Medical Waste (bio-hazardous), Chemotherapy Waste, waste residues, absorbents and PPE, etc waste is to be destroyed in accordance with all local, state, federal and EPA laws and regulations. The Contractor is individually and solely responsible for complying with all government regulation regarding Regulated Medical Waste. The Contractor is fully responsible for transport, storage, and disposal (TSD) of all regulated RCRA Listed hazardous waste and pharmaceutical (RCRA Listed) hazardous waste generated by the facilities. These wastes are to be destroyed at only approved sites and in accordance with all USEPA, state, and local regulations, statutes, and codes. Disposal of destroyed Regulated Medical Waste (bio-hazardous), and Chemotherapy Waste shall be only at an approved disposal site as required by the local and state government authority having jurisdiction. Any medical waste to include syringes and sharps that contain protected health information labeling must be rendered unreadable. The contractor shall provide 10, 32, 40 and 44 gallon barrels (will accept variations in size) with liners. All barrels and liners will be labeled according to all federal, state and local regulations. Any changes to type, size, amount of equipment, and the frequency of service may be mutually agreed to in writing by both parties without affecting the validity of the contract. 2.1. DEFINITIONS Regulated Medical Waste: The term Regulated Medical Waste as used herein, shall include only those wastes defined by the United States Environmental Protection Agency (USEPA) as infectious wastes in its Guide of Infectious Waste Management #EPA/530-SW-86-014, May 1986 and any other wastes identified as infectious or similar wastes in any other applicable federal, state, country or municipal laws, regulations and guidelines. A waste or reusable material that contains an infectious substance and is generated in the diagnosis, treatment, or immunization of human beings or animals; research pertaining to the diagnosis, treatment of human beings or animals and the production or testing of biological products and refers to the following categories of wastes which require special handling, at a minimum: 1. Liquid or semi-liquid blood or other potential infectious material (OPIM). 2. Items contaminated with blood or OPIM and which would release these substances in a liquid or semi-liquid state if compressed. 3. Items that are caked with dried blood or OPIM and are capable of releasing these materials during handling 4. Contaminated sharps 5. Pathological and microbiological wastes containing blood or OPIM 6. Chemo-waste The term Regulated Medical Waste specifically excludes corrosive, reactive, radioactive, toxic, and other Regulated Medical Wastes and substances as defined in any applicable federal, state, county or municipal laws, regulations and guidelines. 2.2. Collins CBOC. c.Pick-ups will be quarterly for the Sidney CBOC. The contractor shall pick-up regulated medical waste between the hours of 8:00 AM through 4:30 PM on regular clinic days. The contactor shall not pick-up medical waste outside of the designated hours. The scheduled pick-up times will be mutually agreeable to both parties. The above pick-up frequency may be changed to accommodate the needs of the clinics by written agreement between the parties. The contractor is responsible for notifying the appropriate Government official at each site for arrangements for the pick-up of the Regulated Medical Waste. If routine pick-up is scheduled on a recognized Government holiday, then the pick-up must be rescheduled and picked-up either within three (3) days before or after the holiday. The 10 national holidays observed by the Federal Government are as follows: New Year's DayLabor DayMartin Luther King's Birthday Columbus DayPresidents DayVeterans Day Memorial DayThanksgiving DayIndependence Day Christmas Day Or any other day specifically declared by the President of the United States to be a National Holiday. 3.0. PERSONNEL Contractor employees will not be considered or treated as federal employees for any purpose, will not be regarded as performing a personal service, and will not be eligible for civil service employee benefits, including retirement. Contractor employees shall identify themselves as Contractor employees in all communication modes used in performing the services, e.g. email, telephone, verbal. Services furnished by contractor employees will be performed as necessary to fulfill the requirements of this PWS. All Contractor employees shall be trained in the proper DOT, EPA, and DEQ handling requirements. The Contracting Officer reserves the right to request the Contractor to provide another employee if an employee does not obey VAMC directives, or does not act in the best interest of the Government. The Contractor shall be responsible for protecting the personnel that are furnishing the services under this contract. To carry out this responsibility, the contractor shall provide the following for their personnel: "Worker's Compensation "Professional Liability Insurance "Income Tax Withholding "Social Security Payments 3.1. EDUCATION AND TRAINING REQUIREMENTS. The Contractor shall provide training to the employees at all the facilities (if required) for proper packaging of waste prior to the start up of the contract collection. The Contractor reserves the right to decline to accept for collection, transportation, treatment of disposal of any Regulated Medical Wastes with cannot be transported, treated or disposed of in a lawful manner or without a risk of harm to public health or the environment. Improperly packaged, leaking, overweight or damaged containers are subject to rejection. No containers will be picked up that are wet or leaking. Repackaging of the waste by the Contractor will be reimbursable when prior approval of the VA representative is acquired. 4.0. SPECIAL CONTRACT REQUIREMENTS 4.1. CONTRACTOR SUBMITTALS Prior to commencement of any work, the Contractor and employees working on this contract shall submit to the Contracting Officer: a.The required licensure required for Federal, State, or local permits that states that he or she is permitted to operate as a transporter and disposal of regulated medical waste. b.Certificates of Insurance 4.2. RECORDKEEPING In the performance of all services to be provided hereunder, the Contractor agrees to comply with all applicable permits, all applicable federal, state, county, and municipal laws and ordinances and all lawful orders, rules, regulations and guidelines of any duly constituted authority, including but not limited to social security, income tax withholding laws, unemployment compensation laws, environment, safety and health laws and manifesting requirements. The Contractor and its affiliates shall keep and retain adequate books and records and other documentation including personnel records, correspondence, instructions, plans, receipts, vouchers, copies of all manifests and any other records or repots or memoranda, consistent with and for the period required by applicable regulatory requirements and guidelines pertaining to performance of the services. 4.3. DOCUMENTATION OF SERVICES RENDERED The contractor shall provide a log sheet at the time of the Regulated waste pick-up. The original copy will be given to the VA Contracting Officer Representative (COR) or local on-site Point of Contact (POC). The log sheet shall state the date of pick-up, the number of boxes taken, the weight of the boxes, the signature of the contractor representative and signature of the VA COR or POC. 4.4. HANDELING OF MEDICAL WASTE 4.4.1. Material Safety Data Sheets (MSDS) The Contractor shall collect a copy of all MSDS from each facility for each individual item that is being picked-up and transported for disposal. The COR and/or local station POC will provide the contractor with the MSDS prior to the contractor leaving the station. 4.4.2. SPILL HANDLING The Contractor shall report all spills to the facility's designated official and to the COR and/or local station POC. The contractor will be legally and financially responsible for the cost of all clean-up of spills created by the contractor. The contractor will be required to clean-up any spills created during the collection process 5.0. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP) Performance ObjectiveSurveillance MethodPerformance Threshold Medical Waste collected at required intervals. Waste collected and bags/liners are replaced. 100% review Four (4) valid defects per year. The Contractor shall ensure the confidentiality of all patient information. 100% review No defects allowed. The Contractor shall provide monthly record of the weights for medical waste picked up from each site. 100% review Four (4) valid defects per year. Contractor will supply annual CY reports of weights and costs for all facilities to the GEMS Coordinator. 100% reviewBy January 31st of each year. 6.0. QUALITY CONTROL/ASSURANCE 6.1. QUALITY CONTROL. The Contractor is responsible for ensuring services are performed in accordance with PWS requirements. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 5, Quality Assurance Surveillance Plan. 6.1.1. DOCUMENTING PERFORMANCE. Environmental Maintenance Service (EMS) personnel or Environmental Management (EM) personnel will verify performance of the contractor. EMS or EM personnel will contact the COR of any discrepancies. The COR will document any deficiencies in writing and forward them to the contracting officer. 7.0 INFORMATION SECURITY AND PRIVACY 7.1 PATIENT SECURITY AND PRIVACY 7.1.1. GENERAL Contractors, contractor personnel, subcontractors, and subcontractor personnel shall be subject to the same Federal laws, regulations, standards, and VA Directives and Handbooks as VA and VA personnel regarding information and information system security. The contractor/subcontractor must receive, gather, store, back up, maintain, use, disclose and dispose of VA information only in compliance with the terms of the contract and applicable Federal and VA information confidentiality and security laws, regulations and policies. If Federal or VA information confidentiality and security laws, regulations and policies become applicable to the VA information or information systems after execution of the contract, or if NIST issues or updates applicable FIPS or Special Publications (SP) after execution of this contract, the parties agree to negotiate in good faith to implement the information confidentiality and security laws, regulations and policies in this contract. If VA determines that the contractor has violated any of the information confidentiality, privacy, and security provisions of the contract, it shall be sufficient grounds for VA to withhold payment to the contractor or third party or terminate the contract for default or terminate for cause under Federal Acquisition Regulation (FAR) part 12. For service that involves the storage, generating, transmitting, or exchanging of VA sensitive information but does not require C&A or an MOU-ISA for system interconnection, the contractor/subcontractor must complete a Contractor Security Control Assessment (CSCA) on a yearly basis and provide it to the COR. 7.1.2. SECURITY INCIDENT INVESTIGATION The term "security incident" means an event that has, or could have, resulted in an unauthorized access to, loss or damage to VA assets, or sensitive information, or an action that breaches VA security procedures. The contractor/subcontractor shall immediately notify the COR and simultaneously, the designated ISO and Privacy Officer for the contract of any known or suspected security/privacy incidents, or any unauthorized disclosure of sensitive information, including that contained in system(s) to which the contractor/subcontractor has access. To the extent known by the contractor/subcontractor, the contractor/subcontractor's notice to the VA shall identify the information involved, the circumstances surrounding the incident (including to whom, how, when, and where the VA information or assets were placed at risk or compromised), and any other information that the contractor/subcontractor considers relevant. With respect to unsecured protected health information, the business associate is deemed to have discovered a data breach when the business associate knew or should have known of a breach of such information. Upon discovery, the business associate must notify the covered entity of the breach. Notifications need to be made in accordance with the executed business associate agreement. In instances of theft or break-in or other criminal activity, the contractor/subcontractor must concurrently report the incident to the appropriate law enforcement entity (or entities) of jurisdiction, including the VA OIG and Security and Law Enforcement. The contractor, its employees, and its subcontractors and their employees shall cooperate with VA and any law enforcement authority responsible for the investigation and prosecution of any possible criminal law violation(s) associated with any incident. The contractor/subcontractor shall cooperate with VA in any civil litigation to recover VA information, obtain monetary or other compensation from a third party for damages arising from any incident, or obtain injunctive relief against any third party arising from, or related to, the incident.
