- JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm fixed-price delivery order issued under a National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) IV contract for Sencha brand name software, which includes Sencha Ext JavaScript (JS), Sencha Touch, Sencha Touch Charts, Eclipse Plugin for Ext JS, Sencha Architect and 12 months of Premium Support for Ext JS and Sencha Touch. 3. Description of Supplies or Services: The proposed action is for the procurement of Sencha brand name software licenses, including Sencha Ext JS, Sencha Touch, Sencha Touch Charts, Eclipse Plugin for Ext JS, Sencha Architect and 12 months of Premium Support for Ext JS and Sencha Touch. The Sencha suite of products and services required is a set of tools that will support creation of tablet-based applications (apps). The specific tools/products required are as follows: a. Sencha Ext JS: A web framework of development libraries that enables developers to use a model-view-controller architecture when building apps. The new Model-View-Controller (MVC) enables apps to leverage features like infinite Scrolling a Grid to build an entirely new level of interactivity into web apps. b. Sencha Touch: An application framework built specifically to leverage HTML5, CSS3, and Javascript for the highest level of power, flexibility, and optimization. Product uses HTML5 to deliver components like audio and video, as well as a local Storage proxy for saving data offline. Product makes extensive use of CSS3 in stylesheets to provide robust styling. c. Sencha Touch Charts: An application framework that allows the user to create charts and graphs for use in tablet applications. d. Eclipse Plugin for Ext JS: Allows for rich code completion, error correction, and Eclipse-based team collaboration to facilitate ease in building complex applications in large and distributed team environments. e. Sencha Architect: An HTML5 visual application builder enabling users to design, develop, and deploy applications from a single, integrated environment. f. Sencha Premium Support: Provides for technical support for 12 months and also provides for free upgrade to the next major version release of the Sencha products. The total estimated price of the proposed action is $ 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited: The Sencha product suite of developer tools are already in use in the current Health Management Platform (HMP) Collaborative Development Environment. HMP provides a collaborative development environment for multiple development partners and pilot sites. The HMP prototype has a universal user interface for the electronic health record and includes data connectors to link the HMP platform securely to patient data from any source to include Department of Defense (DoD) systems. Sencha gives VA developers the ability to prototype applications and provides a powerful code editor that improves productivity and allows the developers to work in lock-step to create applications with other partners. Switching to another vendor's product, even if one with similar capabilities could be located, would result in development delays that would negatively impact the quality of software provided or could even threaten the continuity of operations. In addition, fundamental changes to the development environment could also impact HMP's ability to collaborate with downstream DoD systems to facilitate data sharing across the VA and DoD healthcare information systems. If another robust developer tool could be identified, selecting another brand of software would lead to additional expenses. For example, 3-6 developers working 60-90 days at approximately $116 dollars an hour to decommission and standup and new system would cost approximately $111,000 to $335,000 with training costs and result in a delayed system. These costs could not be recovered through subsequent competition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.202(a)(6), this effort is exempt from pre-award synopsis since the proposed contract action is an order placed under an existing Indefinite Delivery/Indefinite Quantity contract. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any suites of products available that will enable future requirements to be competed. 8. Market Research: VA's technical experts conducted market research in March 2013 by researching similar products for the Sencha product requirements. The products researched were Adobe Flex and Highcharts. The Adobe Flex and Highchart websites were reviewed to determine if available functionality was equal to the Sencha products. Adobe Flex does not support mobile or tablet application development and Highcharts only does charting. Research determined both products have security shortfalls for operation within the VA enterprise and would not provide the full capabilities that the Sencha brand provides. Further market research was conducted via the NASA SEWP IV Product Verification and Manufacturer Lookup tool indicated that the required Sencha software is available only from one Service-Disabled Veteran-Owned Small Business Value Added Reseller (VAR) in Group B and one Small Business VAR in Group C on the NASA SEWP IV contract vehicle. 9.
