- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. PRIORITY 3 ACQUISITION MEMORANDUM FOR RECORD FOR OTHER THAN FULL AND OPEN COMPETITION BELOW THE SIMPLIFIED ACQUISITION THRESHOLD 1. Contracting Agency: Southern Regional Contracting Office, San Antonio Military Medical Center (SAMMC) (aka: BAMC), Fort Sam Houston, TX 78234 2. Description of Action: Priority 03 urgent procurement for Epicel-CEA skin grafts needed for a non-routine surgery. This action has an unusual and compelling urgency that could be detrimental to the patient's life as well as the hospital's overall medical mission. 3. Description of Products/Services: This requirement is for Epicel-CEA skin grafts needed for a patient in critical condition with over 80% total body surface area burns who will undergo surgery at San Antonio Military Medical Center (SAMMC), Ft Sam Houston, TX. 4. Authority Cited: Pursuant to FAR Part 13.106-1(b)(1), Soliciting competition. For purchases not exceeding the simplified acquisition threshold, contracting officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency). -Pursuant to FAR Part 5.202(a)(2), Exceptions. The unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c)(1), Soliciting competition. Price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by SSG Michica Trillo, NCOIC, Burn Unit, OR and Jo Collins on 25 Mar 2013. The Epicel-CEA skin grafts are lab grown epidermal tissue the company requires at least nine days notice to prepare the product and schedule arrival. These skin grafts must be received for non-routine surgery on 11 April 2013. If the physician does not have these skin grafts for the surgery, it could be detrimental to the patient's life as well as the hospital's overall medical mission. 6.
