Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity. This justification is executed by the Naval Medical Logistics Command, Fort Detrick, MD to meet the requirements of Naval Medical Center Portsmouth and Naval Hospital Camp Lejeune. 2. Nature and/or description of the action. The requirement is for an endoscopic video system and three gastroscopes for Naval Hospital Portsmouth and one (1) endoscopic video system, one (1) laryngoscope, and two (2) rhinolaryngoscopes for Naval Hospital Camp Lejeune. The Government intends on awarding a Firm Fixed Price contract. The proposed source is Olympus America Inc, 3500 Corporate Pkwy, Center Valley PA, 18034. 3. Description of the supplies/services required. • NMC Portsmouth Naval Medical Center Portsmouth has a requirement for one endoscopic video system and three gastroscopes. The endoscopic video system shall include a video-image detection and processing system, a light source, a printer, a procedure cart with monitor, and roll stand with monitor. The endoscopic video system shall be capable of obtaining images of the interior of the gastrointestinal tract for diagnostic and therapeutic procedures. The endoscopic video system and gastroscopes shall be compatible with the installed base of Olympus endoscopy equipment at Naval Medical Center Portsmouth. The power requirement is 120VAC, 60Hz. • NH Camp Lejeune Naval Hospital Camp Lejeune has a requirement for one (1) endoscopic video system, one (1) laryngoscope, and two (2) rhinolaryngoscopes. The endoscopic video system shall include a video-image detection and processing system, an image capture system, a stroboscopy system, a camera head, a light source, a printer, and a procedure cart with monitor. The endoscopic video system shall be capable of obtaining images and video of the interior of the upper respiratory tract for diagnostic and therapeutic procedures. The video-image detection and processing system, image capture system, camera head, laryngoscope, and at least one of the rhinolaryngoscopes shall be capable of obtaining images and video with a minimum resolution of 1,080 pixels/line (HD), and with digital chromoendoscopy. The HD rhinolaryngoscope(s) shall be flexible, and have a maximum distal outer diameter of 4.0 mm. At least one of the rhinolaryngoscopes shall be flexible and shall have a maximum distal outer diameter of 3.0 mm. The rhinolaryngoscopes shall have a minimum field of view of 90 degrees, with an angulation capability of at least 130 degrees up and 130 degrees down. The laryngoscope and camera head shall be capable of being sterilized by steam sterilization. The rhinolaryngoscopes shall be capable of being sterilized by liquid germicide sterilization. The power requirement is 120VAC, 60Hz. Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. 4. Identification of the statutory exceptions permitting other than full and open competition. The statutory exception permitting other than full and open competition for this acquisition is 10 USC 2304(c)(1) and FAR 13.501(a), sole source acquisitions. 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. • NMC Portsmouth Olympus America, Inc. is the only vendor that can meet the minimum requirements of the government. Olympus America, Inc. is the only vendor that is capable of providing an endoscopic video system and gastroscopes compatible with the installed base of Olympus endoscopy equipment at Naval Hospital Portsmouth, and flexible rhinolaryngoscopes capable of obtaining images and video with a minimum resolution of 1,080 pixels/line (HD), with a maximum distal outer diameter of 4.0 mm at Naval Hospital Camp Lejeune. Naval Hospital Portsmouth has an installed base of Olympus endoscopy equipment including bronchoscopes, colonoscopes, gastroscopes, duodenoscopes, aspirators, light sources, and video systems having an estimated total replacement cost of well over $2 million. Endoscopy equipment features vendor-specific proprietary fittings such that system/scope intercompatibility is achieved using equipment from the same vendor. Intercompatibility of systems and scopes is essential to ensuring uninterrupted workflow and maintaining patient standard of care. In the event that one or more of the acquired endoscopes is rendered unusable, endoscopes from other systems or areas of the hospital would be able to be used in conjunction with the acquired endoscopic video system to maintain workflow and patient standard of care. If endoscopy equipment from another vendor were purchased for this requirement, a situation would be created where system/scope intercompatibility would not be possible. The only alternative to acquiring the required equipment from Olympus America would be to replace the entire installed base of equipment at significant duplicative cost to the government. • NH Camp Lejeune Olympus America, Inc. is the only vendor that can meet the minimum requirements of the government. Olympus America, Inc. is the only vendor that is capable of providing flexible rhinolaryngoscopes capable of obtaining images and video with a minimum resolution of 1,080 pixels/line (HD), with a maximum distal outer diameter of 4.0 mm. The capability of acquiring HD video during endoscopic otorhinolaryngological (ENT) diagnostic and interventional procedures is essential for ensuring adequate patient standard of care. It is essential that the distal outer diameter of the HD scope be no more than 4.0 mm to ensure unobstructed scope insertion through the internal nasal valve for at least 95% of the population of adult patients. There would simply not be enough room in the anatomy of most patients to accommodate an HD scope with a distal outer diameter of more than 4.0 mm. A distal outer diameter of no more than 4.0 mm also allows for closer examination of the larynx than is possible with larger diameter scopes. No other vendor besides Olympus America can provide HD video flexible rhinolaryngoscopes which meet the minimum requirements. Olympus America, Inc. is also the only vendor that is capable of providing a flexible video rhinolaryngoscope with a maximum distal outer diameter of no more than 3.0 mm. A maximum distal outer diameter of no more than 3.0 mm is essential for examining pediatric patients. It is also sufficiently small to enable conscious patient examination for at least 95% of the population of adult patients. Only Olympus America can provide an endoscopic video system and gastroscopes compatible with the installed base of Olympus endoscopy equipment at Naval Hospital Portsmouth, and provide flexible video rhinolaryngoscopes with a diameter small enough to examine a patient while conscious at Naval Hospital Camp Lejeune. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable. Market research was performed, the results of which are in paragraph 8. This requirement will be posted to NECO and/or FedBizOpps in accordance with FAR 5.202. The government will evaluate any responses received. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor's commercial price list and will be determined fair and reasonable. 8. Description of the market survey conducted and the results, or statement of the reasons a market survey was not conducted. • NMC Portsmouth Market research was conducted in December 2012. It included a search of the Internet using Google, Yahoo, MSN, and GSA Advantage. Federal Supply Schedule vendors which can provide gastroscopes include Karl Storz, Micromed, Olympus America, and Pentax. Of these vendors, Karl Storz, Micromed, and Olympus America are also capable of providing endoscopy video systems on the Federal Supply Schedule. Additionally, open market vendor Stryker is capable of providing gastroscopes and endoscopy video systems. However, Karl Storz, Micromed, and Stryker are not capable of providing an endoscopic video system and gastroscopes which are compatible with the installed base of endoscopy equipment at Naval Hospital Portsmouth. Olympus America is the only vendor which can provide an endoscopic video system and gastroscopes compatible with the installed base of Olympus endoscopy equipment at Naval Hospital Portsmouth. No other vendor can provide endoscopic video system and gastroscopes compatible with the installed base of Olympus endoscopy equipment at Naval Hospital Portsmouth. • NH Camp Lejeune Market research was conducted in January 2013. It included a search of the Internet using Google, Bing, and GSA Advantage. Vendors which can provide flexible video rhinolaryngoscopes include Karl Storz, Olympus America, and Pentax. Other vendors which are capable of providing flexible video laryngoscopes, but not rhinolaryngoscopes, include Richard Wolf, Verathon, Vision Sciences, and Welch Allyn. Of the sources identified, the only vendors which can provide an HD video flexible rhinolaryngoscope include Olympus America and Pentax. However, the distal outer diameter of the HD video flexible rhinolaryngoscope offered by Pentax is larger than 4.0 mm, and thus does not meet the minimum requirements of the government. The HD video flexible rhinolaryngoscope offered by Olympus is the only one commercially available which meets the minimum requirements. Additionally, the only vendor which can provide a flexible video rhinolaryngoscope with a maximum distal outer diameter of at most 3.0 mm is Olympus America. No other vendor can provide a flexible video rhinolaryngoscope with a maximum distal outer diameter of 3.0 mm. Olympus America is the only vendor which can meet the minimum requirements of the government. 9. Other facts supporting the use of other than full and open competition. None. 10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition. To date, no other sources have written to express an interest. This requirement will be posted on FedBizOpps in accordance with FAR 5.202. Any sources expressing interest in response to the synopsis will receive consideration. 11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Future requirements will be synopsized in accordance with FAR 5.203. For the reasons set forth in Paragraph 5, Naval Medical Logistics Command has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, Naval Medical Logistics Command will assess whether competition for future requirements is feasible. However, there is constant attention to the market to insure that shall technology change, the source selection is reconsidered. U.S. Navy Subject Matter Experts are required to take into consideration the impact on the installed base of equipment when source selection occurs. All necessary components of integrated logistics support are taken into consideration.
