Subject: Coventor, Inc. Sole Source Notice of Intent Reference Number: NB620030-13-03514 Notice Type: Pre-Solicitation Notice- Notice of Intent Synopsis: The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the NIST Center for Nanoscience and Technology (CNST), intends to negotiate with Coventor, Inc.; Cary, NC, on a sole source basis under the authority of FAR Subpart 13.106-1 (b), Soliciting from a Single Source, to purchase/renew software on existing CoventorWare software licenses for 1 year. The National Institute of Standards and Technology (NIST) Center for Nanoscale Science and Technology (CNST) enables science and industry by providing essential measurement methods, instrumentation, and standards to support all phases of nanotechnology development, from discovery to production. This acquisition is required for finite element numerical analysis of complex MEMS and NEMS devices in 3 dimensions. A software package is needed for finite element numerical analysis of complex MEMS and NEMS devices in 3 dimensions. This software must be capable of importing, exporting and generating 3D models of devices, meshing them and solving various multi-physics problems. It should provide convenient and versatile visualization and data export capabilities for solutions. Additionally, the software should provide the ability to setup and execute automated series of simulations for parametric analyses. Finally, the software should provide efficient boundary element method algorithms for solving electrostatic problems with large and complex conductor shapes. An extension of license is required for the CoventorWare Turbo software package that is currently being used in our laboratory. NIST needs to continue to be able to model MEMS devices, including use of the models and data that have been generated with this software over the last several years. NIST has been using CoventorWare software for several years and has generated a significant amount of modeling data with it. Market research has shown that the CoventorWare Turbo software package can meet the requirements of NIST and that no other software package is compatible with the significant amount of data previously generated by NIST. By not renewing the CoventorWare license and purchasing different software, NIST would lose access to the extensive results obtained over the last several years. Furthermore, recent market research conducted by NIST shows that Coventor, Inc. is the only authorized provider of this software in the United States. Coventor, Inc. has the sole proprietary and patent rights to this software. NIST intends to procure an annual software license for CoventorWare, to include all upgrades, technical support, and electronic documentation. The NAICS Code is 511210 with a Size Standard of $25.0 million. NIST anticipates negotiating and awarding a firm-fixed-price purchase order to Coventor, Inc. for this requirement during the third quarter of Fiscal Year 2013. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
