Description
The Department of Veterans Affairs, VA Boston Healthcare System, has a requirement for operation, training, service, and maintenance on a new constructed liquid nitrogen storage facility. A fixed price requirements contract with a performance period of September 1, 2013 through August 31, 2014 is anticipated and shall be awarded. It is the Government's belief that only the vendor that designed and built the facility possesses the required capabilities to successfully meet this requirement. It is the Government's intention to solicit and negotiate only with this source. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Inquiries/information received after the established deadline shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-1. Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 1, VA Boston Healthcare System (523-13-3-8183-0232) - MAVERIC / Research 151, 150 South Huntington Avenue, Boston, MA 02130 is requesting a sole source engagement for services from: 2.Nature and/or Description of the Action Being Processed: This is a new contract to provide operation, service, and maintenance of the newly purchased XXX instrument - XXX designed, developed, and constructed for the VA's Central Biorepository located at MAVERIC at VHA Boston at Jamaica Plain campus. The XXX is a large liquid nitrogen cooled robotic DNA store. It will provide long-term storage of Veterans DNA samples to be used for research. This very sophisticated instrument will allow the VA to get very large numbers of DNA samples - a process that would be impossible if done manually. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The MAVERIC Biorepository requests that XXX provide a Field Service Engineer (FSE) to operate the XXX from 1 August 2013 to 30 Sept 2014. Training is also requested as the VA is currently approved to hire an operator of the XXX. The VA employee is expected to be fully onboard within 9 months to 1 year and will overlap the performance period of the FSE. The FSE will train the VA employee. XXX will provide repairs and service to the XXX. XXX will provide maintenance for the XXX. In general, for the performance period of the contract XXX will operate and maintain the XXX in good working condition as stipulated in the Statement of Work. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304 as implemented by: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Due to the nature and uniqueness of this highly specialized system, no other offers were solicited. XXX was contracted by the VA to build a custom DNA storage facility that would allow a significant reduction in electrical power costs to the VA on an annual basis. XXX invented and created the XXX - a Liquid Nitrogen cooled storage facility that uses sophisticated robotics, software, engineering, environmental systems, and other systems. XXX having designed and built this unique facility is best suited to perform service, maintenance, and operation of this critical piece of equipment. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the nature and uniqueness of this highly specialized system, no other offers were solicited. XXX was contracted by the VA to build a custom DNA storage facility and they possess the highly desirable skills and qualifications needed to performance maintenance. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Estimated costs for 1 year of training, engineering support and maintenance is estimated to cost $XXX. Price analysis will be performed in accordance with FAR 13.106. A determination of fair and reasonable pricing will be made prior to award. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: An independent government cost estimate was prepared to assess the appropriateness of quote received by XXX. During that process we assessed the ability of another company to perform service tasks presented in quotes and SOW and found that other companies have no desire to be involved and that XXX would best serve the government's needs. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: XXX, Inc. has proprietary rights to the software and hardware that make up the XXX. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Developments in the commercial marketplace are reviewed and competition may be possible at a later date. Competition is sought whenever practical.
