Description
This is a combined Synopsis/Solicitation/Notice of Intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested and a written solicitation will not be issued for the solicitation number NIAID-NOI-13C-1639424, a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-68, dated June 26, 2013. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. The associated North American Industry Classification System (NAICS) Code is 112990, which has a small-business size standard of $0.75 in millions of dollars. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure 16 - 1 year old Rhesus Monkeys (either gender) on a sole source basis from the University of California, Davis. This is the only known vendor to provide 16 animals of the same age that are seronegative for the Epstein-Barr and cytomegalovirus viruses. We have previously obtained the Rhesus Monkeys from this vendor, which other sources provide monkeys that have different backgrounds and cannot be pooled with others. Animals with different environmental backgrounds will have different responses to vaccines and this cannot be adequately controlled. The University of California, Davis will house and raise the monkeys for one (1) year to avoid becoming infected, and perform nursery per diem, regular per diem, veterinarian - clinical support, animal technician - sample collection, weights, laboratory test, and supplies. The following factors shall be used to evaluate offers: 1) capability to produce 16 - one (1) year age Rhesus Monkeys, and perform required services, 2) comply with NIAID animal assurance of handling animals, 3) price, and 4) delivery. Period of performance will be for one year from date of award. This will be a fixed price contract. The FOB terms are 'Destination' and Net 30. The following Federal Acquisition Regulations provisions and clauses apply to the acquisition: FAR 52.212-1 Instructions to Offerors Commercial Items; Far 52.212-2 Evaluation Commercial Items; Far 52.212-3 Offeror Representation and Certifications Commercial Items; Far 52.212-4 Contract Terms and Conditions Commercial Items; Far 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items; and FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003). A completed copy of provisions at FAR 52.212-3 Offerors Representation and Certifications Commercial Items must be included which can be found online at System for Award Management (SAM) https://www.sam.gov. By submission of an offer, the Offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. [Note: Lack of registration in SAM will make an Offeror ineligible for award.] All responsible sources may submit an offer that will be considered by the Agency. Offers must be submitted no later than 5:00 P.M. Eastern Daylight Savings Time (EDST) on Tuesday, August 13, 2013 through the U.S. Postal Service at the address of NIH/NIAID/AMOB, 10401 Fernwood Drive, Room 2NE38A, MSC 4811, Bethesda, Maryland 20892-4811.
