- This is a combined/synopsis/solicitation Notice of Intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NIAID-NOI13-D1640218 and the solicitation is being issued as a Notice of Intent on a sole source basis. This solicitation document and its incorporated provisions are those in effect through the Federal Acquisition Circular (FAC 2005-68) date of June 26, 2013. This acquisition will be processed under Simplified Acquisition Procedures and is not a Small Business Set-Aside. The National Institute of Allergy and Infectious Disease (NIAID) intend to procure from Life Technologies Corp. at this time the only known source for the ABI Big Dye; BDT V3.1 RR-5000 & SEQ BUFFER. Employing other chemistry would result in shorter reads, a greater cost to the institute due to a need to utilize several more reactions for each project & ultimately greater personnel costs. The supplies & reagents must be compatible with the laboratory equipment currently being used in the laboratory. Any other product would jeopardize the equipment (this source is the manufacturer/distributor). Award will be based on: 1) Technical capabilities to meet the required specifications, 2) Delivery, 3) Installation, 4) Warranty, and 5) price. Warranty information to include period and coverage, shall be stated. Inside delivery shall be 30 days after the receipt of order (ARO). The North American Industry Classification System (NIACS) Code for this acquisition is 334516, and the small-business size standard is 500 employees. This is a fixed-price contract and the FOB terms are 'Destination' and Net 30. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR52.212-2 Evaluation-Commercial Items, FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR52.212-4 Contract Terms and Conditions Commercial Items: FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, FAR 52.232-33, Payment by Electronic Funds Transfer- Central Contractor Registration. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://sam.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM at www.sam.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the System for Award Management will make an offeror ineligible for award.] All responsible sources may submit an offer that will be considered by the Agency. Offers must be submitted no later than 4:00 P.M. Eastern Time on Monday August 12, 2013.
