- Description
- The Public Buildings Service, Rocky Mountain Region, proposes to contract the requirements described herein by means of other than full and open competition. Contracting by such means is authorized test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996). 1. Contracting Activity. General Services Administration, Public Buildings Service, Denver Federal Center, Lakewood, Colorado 2. Description of Required Supplies or Services: This justification authorizes and approves the issuance of a Firm Fixed Price contract to Restoration Logistics Property Repair for remediation of stormwater flooding in Buildings 20, 25, 40, 41, 45, 53, 56, 67, and 85. This effort is covered under the Acquisition Plan #268482530 dated July 19, 2013. The total estimated dollar value of this requirement is $465,313.00. 3. Statutory Authority. The statutory authority permitting other than full and open competition is 4202 of the Clinger-Cohen Act of 1996. 4. Demonstration of Contractor's Unique Qualifications: While there are many firms that are qualified to perform the cleanup services, there was not time to compete this requirement because the flooding started after a 5:00 pm rainfall on Saturday, July 13, 2013, and water damage needed to be mitigated immediately. The Contracting Officer (CO) came in to the office at approximately 7:30 p.m. to find a remediation/restoration service that could respond immediately. The CO reviewed the Small Business Administration (SBA) search looking for an 8(a) firm that could perform the services. The search was conducted under search words "water damage" or NAICS 562911 Remediation Services and the 8(a) firm, Cleaning Restoration Experts LLC Care, in Cortez Colorado was found. This firm, however, is located in southern Colorado and was 465.62 miles or 7 hours 30 minutes from Lakewood, Colorado. From the list of firms on the Google website, the CO called Colorado Cleanup Services Inc. first who was too busy and not available until the next day. The CO then called Restoration Logistics Property Repair who was able to be on site within 45 minutes. The history, strategy, market and qualifications are evident in the attached sheets from the firm's website. 5. Actions Taken to Remove Competition Barriers and Solicit Offers from Other Sources. This procurement was an emergency situation where flooding was occurring in various buildings and immediate mobilization by the firm was required to mitigate further damage to the buildings and furnishings. 6. Determination that the Anticipated Cost/Price will be Fair and Reasonable. The Contracting Officer shall ensure that all supplies and services ordered under the proposed contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with cost or pricing data or sufficient information to support the accuracy and reliability of the estimate. Restoration Logistics Property Repair's proposed cost will be reviewed by the program manager, contract specialist and others as warranted with unique pricing or technical expertise related to the requirement. The Contracting Officer will utilize an appropriate variety of price or cost analysis techniques and technical analysis to ensure negotiations of a fair and reasonable price. 7. Market Research, FedBizOpps Announcement, and Listing of Interested Sources. Market research conducted was a search in SBA - Small Business Dynamic Search for an 8(a) firm that could have performed remediation services and when that proved to be unsuccessful, a search was conducted in the Google website for a firm that had the ability to remediate stormwater flood damage and be able to respond immediately to mitigate damages from mold or other contaminates. 8. Any Other Factors Supporting the use of Other than Full and Open Competition. No additional factors. CERTIFICATION: I certify that supporting documentation is accurate and complete to the best of my knowledge and belief. It is appropriate to use such information to establish the basis for this justification.
