- This NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Commercial Items. The authority for this award is FAR 13.106(b), soliciting from a single source; Purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The Office of Personnel Management (OPM) has a requirement, in support of its mission, to provide Continuous Operation and High Availability for the operation of the IBM Parallel Sysplex being used by the Federal Investigative Services (FIS). OPM intends to issue a non-competitive award that will result in a purchase order to Labayne & Associates, Inc. (dba CASI Software), 10231 Slate Avenue, Suite 117, Fountain Valley, CA 92708. The award will provide maintenance of the software license for the CASI software products licensed for an IBM 2096-X02 and an IBM 2096-X03, and an upgrade for (2) IBM zEC12-503s. The IBM Enterprise Servers uses software from CASI called JES2FTP and JES2FTP/RTP which runs on the IBM Enterprise Server. The software takes reports generated on the mainframe and converts the business reports to Portable Document Format (PDF) which can be viewed by Windows users with ADOBE Acrobat Reader. To ensure that OPM/CLD receives consistent, established, and cost efficient software support, it is in the best interest of the Government to procure these services from CASI Software. The North American Industry Classification System (NAICS) Code for this requirement is 511210. THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIREMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible parties who identify their interest and capability to satisfy this requirement will be considered. No solicitation will be issued, therefore, any requests for the solicitation will be considered non-responsive. A determination not to compete this action based upon responses received is at the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via e-mail to Shannon Kennedy Shannon.Kennedy@opm.gov within three (3) days of the published date of this notice. Verification of receipt of electronic transmission is the sole responsibility of the contractor. System for Award Management (SAM) registration is required of all OPM contractors prior to execution of award. If no competitive responses are received, an award will be made to Labayne & Associates, Inc. (dba CASI Software). (ref: AT #12232 & #12743)
