DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Network Contracting Office, VA Medical Center, Hampton, Virginia. The 2237 number is 658-13-3-537-0514 2.Nature and/or Description of the Action Being Processed: This is a sole source justification for an Aquamantys Pump Generator and cart with 6.0 bipolar sealer hand pieces from Medtronic Advanced Energy LLC. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VAMC Durham requires: "1 Aquamantys Pump Generator $30,712.00 "1 Aquamantys Pump Generator Cart $875.60 "10 Aquamantys 6.0 Bipolar Sealers $585.20 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The device applications is specifically designed to seal soft tissue, bone, and blood vessels during orthropedic surgical procedures. The generator system functions by using bipolar radiofrequency energy and saline simultaneously to the surgical field to provide haemostasis or sealing across exposed tissue or bone surfaces. It heats tissues to around 100 degrees centigrade and shrinks the collagen in the walls of the tissue vessels and produces less smoke plume. It uses the technology called transcollation ®. This device uses single use sterile disposable hand pieces/ probes that come in many sizes, shapes, and functions to accommodate surgeons changing procedural needs. The salient characteristics or functions of this equipment are specific to meet the requirements of this acquisition. This machine has been used by the orthopedic surgeons at this facility for performing total joint arthroplasty and require this machine. It provides many health benefits to the veterans who are undergoing orthopedic procedures such as decrease in blood loss, swelling, pain, drainage, faster mobility, and shortens hospital length of stay. This vendor/ manufacturer is the sole proprietary of this advanced energy technology equipment. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Sources Sought Notice (VA246-13-Q-1554) as a brand name or equal to Medtronic's Aquamantys ® System was posted for six days with no other response. 6. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price is a 12% discount off their listed price. This has been determined fair and reasonable by the Contracting Officer. 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted on the web, Sources Sought Notice, and Government Databases that concluded with limited resources for the end users requirements stated in paragraph five. The Sources Sought notice results confirmed the decision to sole source this requirement. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: See above. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Firm 1: Medtronic, Inc. 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted for subsequent acquisitions to ensure fair and open competition.
