1.Contracting Activity: Department of Veterans Affairs, VISN 6, Salem Medical Center submits a justification for other than full and open competition for purchase request 658-13-3-537-0512. 2.Nature and/or Description of the Action Being Processed: The Salem VAMC requires a second Arthroscopy Video System. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Salem VAMC requires the following items, totaling $132,093.25. Description Wise 26 in HDTV surgical D TV vision elect surgical 1188HD CCU L9000 Light source Standard video cart kit SDC3 base w/ Kodak printer kit Flat Panel Roll Stand Kit WHDTV wireless Transmitter 1188 A/C camera HD 4mm x 30 deg. Pump cannula 5.8mm w/2 R Pencil Obturator 5.8mm P cutter cannula whole 4.5 obturator 4.5mm fiber optic cables 5.0mm 1188AC coupler Irrigation adapter trocar 4.5mm 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Orthopedic surgical equipment was purchased in FY12 and is currently in use by orthopedic surgeons to perform Arthroscopy/ Endoscopy procedures in joints (hips, carpels, knees, shoulders) which can be for diagnostic and/or treatment purposes. The Salem VAMC requests a second system to accommodate a new OR opening at the Salem VAMC that is compatible with the current video system. No other manufacturer video system is compatible with Stryker camera heads and other accessories currently owned and in use at the Salem VAMC. In addition, the Salem VAMC has many Stryker cameras of the same model and scopes that are compatible with the requested system. Finally, the OR is standardizing equipment and requests this Stryker system for maintaining competency of staff both in the Operating Room and SPS. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The FY12 award was competed on FedBizOps. The manufacturer was contacted to determine if multiple vendors were authorized distributers, but only one company has been designated an authorized distributor of these Stryker Orthopedic instruments. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Pricing is the same as that offered in FY12, which was determined to be fair and reasonable at the time of purchase. Additional cost savings will be realized because opening a second orthopedic OR room will drastically decrease the number of patients whose surgeries are delayed and/or performed in area hospitals. Additionally, as two surgeons are currently using the instrumentation, the OR experiences delays, overtime, and extended wait time for the patient to be put on the O.R. schedule because both surgeons utilize this equipment. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was not conducted for this action, as it is a follow on action. Market research was conducted for the original actions. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: When the current equipment is replaced competition will be sought for replacement systems.
