Description
INTRODUCTION: THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR A PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Heart, Lung, and Blood Institute (NHLBI) Office of Acquisitions (OA) on behalf of the National Institute of Dental and Craniofacial Research (NIDCR), intends to negotiate and award a purchase order on a noncompetitive sole source basis to Becton, Dickinson and Company, One Becton Drive, Franklin Lakes, NJ 07417 to procure a Baker BioProtect Class II Type A2 Biosafety Cabinet. Procurement: Baker BioProtect Class II Type A2 Biosafety Cabinet Background: The Flow Cytometry section under CTRC provides FACS cell sorting to all investigators at NIDCR. Investigators at NIDCR need to sort Human Cell lines and Primary Human Cells to perform their research. According to the new NIH Biosafety Policy for Cell Sorters, cell sorters shall be placed in a separate lab with established negative pressure or under a Biosafety Class II Type A2 cabinet to perform BLS2+ (enhanced precautions) sorting. Room 109 where the FACS Aria III is located, is not negatively pressured and hence not in compliance with the safety guidelines. To be able to safely sort under BSL2+ conditions, NIDCR has assessed that purchasing a Biosafety Cabinet is the best option. This option will also expand sorting capabilities in the future and will allow for sterile sorting to infuse the sorted cells into animals. Becton, Dickinson and Company have custom designed a bio-containment enclosure for the BD FACS Aria III that has been verified to meet both the personnel and product protection standards for a Class II Type A2 cabinet and NSF-49 standards. Delivery: Delivery will be made upon award. Justification: The proposed upgrade includes proprietary technology to offer increased biosafety in operation of the existing Becton, Dickinson and Company FACSAria flow cytometer cell sorting system. The upgrade consists of proprietary bioaerosol and fluidics modifications to the existing system. The system will be engineered to operate in a biosafety cabinet specifically designed to provide a laminar air flow over the instrument and evacuation of aerosols. This will provide operator and sample protection from bio aerosols. This upgrade is only available from Becton, Dickinson and Company, the original manufacturer of the FACSAria system. The upgrade contains proprietary parts that are only sold direct by Becton, Dickinson and Company and not through dealers or third party resellers making this a sole source procurement. Regulatory Authority: This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source, only one responsible source and no other supplies or services will satisfy agency requirements. Additional Information: Industry Classification (NAICS) Code is 334516, Analytical Laboratory Instrument Manufacturing and the Small Business Size Standard is 500 Employees. The acquisition is being conducted under FAR Part 13, simplified acquisition procedures, therefore the requirements of FAR Part 6 B Competitive Requirements are not applicable (FAR Part 6.001). The resultant Contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-69 (August 1, 2013). This requirement is under the SAT of $150,000.00. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by August 23, 2013 and must reference synopsis number NHLBI-CSB-(DE)-2013-262-AMS, may be submitted to the National, Heart, Lung and Blood Institute, Office of Acquisition, COAC Services Branch, 6701 Rockledge Drive, Suite 6149, Bethesda, Maryland 20892-7902, Attention: Alice Sobsey. Response may be submitted electronically to sobseyam@nhlbi.nih.gov. Faxes will not be accepted. Responses will only be accepted if dated and signed by an authorized company representative.
