- Description
- The Public Buildings Service, Rocky Mountain Region, proposes to contract the requirements described herein by means of other than full and open competition. Contracting by such means is authorized by FAR Subpart 6.3 and is supported by this justification prepared in accordance with FAR 6.303. 1. Contracting Activity. General Services Administration, PBS, ARRA Project Team, New Custom House. 2. Description of Required Supplies or Services: This justification authorizes and approves the issuance of a Firm Fixed Price contract to Matsuo Engineering/Centerre Construction, A Joint Venture (MC) for the condensing boiler system design and construction for the heating of the New Custom House, 721 19 th Street, Denver, Colorado 80202. The total estimated dollar value of this requirement is $1,289,052.00 which is divided into $1,089,052.00 for the permanent boiler and design and $200,000 for the temporary boilers. It is anticipated that a permanent solution will not be fully operational for the beginning of the cold season requirements, hence the need for a temporary solution. This will allow for the building to stay operational for the tenants. 3. Statutory Authority. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) as cited in FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." 4. Demonstration of Contractor's Unique Qualifications: MC, is the only qualified source to perform this effort because of the following: · Warranty - The contractor installing the proposed condensing boiler system will need to alter major mechanical systems (namely hot and chilled water main circulation pumps, main hot/chilled water piping risers and distibution, BAS/controls, flat plate heat exchangers, relocate new domestic water heaters, etc.) that have been designed and installed by MC as part of the ARRA modernization but have not been accepted as substantially complete and are yet to begin their warranty period. This will likely impact the warranty that MC is willing to support, given that system have been altered. · Energy Performance and other Contractual Requirements - If MC is not use for the boiler project, and should the building mechanical systems fail to satisfy building heating, cooling, or energy consumption measures when the ARRA modernization is complete, it would be difficult to hold Matsuo-Centerre responsible as GSA will have significantly modified the base HVAC system with an outside contractor. Proving who is responsible for not meeting energy goals and other performance requirements could be difficult, if not impossible. · Inherent Knowledge of Existing Systems - As MC is the design builder for the current ARRA modernization, they have a more comprehensive understanding of newly constructed HVAC systems than anyone else. This should help to ensure that the boiler system is properly designed and constructed to meet the needs of the system. · Timeliness - Heating is absolutely required at the Custom House by no later than October 1, 2013. Since MC already has a design-build team assembled, badged, and mobilized on-site, they will certainly be able to complete the project quicker than an outside contractor that is not badged or mobilized and does not have any familiarity with the existing building systems. The sooner the system can be installed, the less time a temporary boiler solution will be needed (if one is needed at all; there is a small chance that MC may be able to install the boiler system prior to October 1. · Logistics - Construction of the boiler system will likely require the installing contractor to work in the same construction areas (basement) as MC will still be working in the ARRA modernization. This could potentially open the door for delay claims, etc. Additional, MC is currently using the courtyard as a staging area for the ARRA construction. If a temporary boiler system is required, it would likely need to be placed in the courtyard for security purposes. At a minimum this would require close coordination with MC. · Costs - Because MC already has a design build team assembled and mobilized, and because that team already has immense knowledge of the building and systems, the GSA should recognize economies of scale due to the minimized effort required to mobilize, investigate, survey, and fully understanding the current building and systems. 5. Actions Taken to Remove Competition Barriers and Solicit Offers from Other Sources. None taken. 6. Determination that the Anticipated Cost/Price will be Fair and Reasonable: In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services ordered under the proposed contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with cost or pricing data or sufficient information to support the accuracy and reliability of the estimate. MC's proposed cost will be reviewed by the program manager, contract specialist and others as warranted with unique pricing or technical expertise related to the requirement. The Contracting Officer will utilize an appropriate variety of price or cost analysis techniques and technical analysis to ensure negotiations of a fair and reasonable price. 7. Market Research, FedBizOpps Announcement, and Listing of Interested Sources. None taken 8. Any Other Factors Supporting the use of Other than Full and Open Competition. Currently the heating system for the New Custom House is not functional. There is a risk that if this problem is not resolved, the GSA will be unable to provide heat to the building for the tenants this winter (2013). Internal experts have confirmed that the lead time for ordering new boilers is 12-14 weeks. It is in the best interest of the Government to resolve this problem as soon as possible. CERTIFICATION (Per FAR 6.303-2(b)): I certify that supporting technical data and/or documentation are accurate and complete to the best of my knowledge and belief. It is appropriate to use such information to establish the basis for this justification.
