Description
DTAR Provision 1052.209-71 - Complete and submit with offer. (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and in conjunction with Part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation is a request for quotation (RFQ). (iii) The solicitation documentation incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-80. (iv) This is a Small Business Set-Aside under NAICS Code 541519, Small Business Size Standard $27.5 million. (v) Contract Line Items: 0001 Toad for Oracle Professional Edition (1020-3515), per seat Maintenance Qty: 90 1001 Toad for Oracle Professional Edition (1020-3515), per seat Maintenance Qty: 90 2001 Toad for Oracle Professional Edition (1020-3515), per seat Maintenance Qty: 90 (vi) The Bureau of Engraving and Printing requires license maintenance renewal of Toad for Oracle, Professional Edition from an authorized provider. (vii) CLIN 0001 Period of Performance: 2/28/2015 - 2/27/2016 CLIN 1001 Period of Performance: 2/28/2016 - 2/27/2017 CLIN 2001 Period of Performance: 2/28/2017 - 2/27/2018 (viii) FAR Provision 53.212-1, Instructions to Offerors - Commercial (Apr 2014), applies to this acquisition. (ix) FAR Provision 52.212-2, Evaluation - Commercial Items (Oct 2014), applies. The following factors shall be used to evaluate offers: technical capability, price, and past performance. Award will be made to the lowest priced, technically acceptable offer. (x) Offerors must include a completed copy of FAR Provision 52.212-3, Offeror Representations and Certifications - Commercial Items (Dec 2014), with its offer. (xi) FAR Clause 52.212-4, Contract Terms and Conditions - Commercial Items (Dec 2014), applies to this acquisition. (xii) FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Dec 2014), applies to this acquisition. The applicable FAR clauses cited in 52.212-5 are: 52.204-10, 52.209-6, 52.219-6, 52.222-21, 52.222-26, 52.222-36, 52.223-18, 52.225-13; 52.232-33, 52.222-41. (xiii) (a) FAR Clause 52.217-9, Option to Extend the Term of the Contract (Mar 2000), is applicable to this acquisition. The fill-ins for paragraph (a) are 15 days and 30 days. The fill-in for paragraph (c) is 36 months. (b) FAR Clause 52.232-40, Providing Accelerated Payments to Small Business Subcontractors (Dec 2013), is applicable to this acquisition. (c) The following Department of the Treasury Acquisition Regulation (DTAR) Clauses are applicable to this acquisition: DTAR 1052.210-70 CONTRACTOR PUBLICITY (Aug 2011) The Contractor, or any entity or representative acting on behalf of the Contractor, shall not refer to the equipment or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract. Further, any violation of this provision may be considered during the evaluation of past performance in future competitively negotiated acquisitions. (End of clause) DTAR 1052.232-1 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (Aug 2012) (a) Definitions. As used in this clause - (1) "Payment request" means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Payment documentation and process" and the applicable Payment clause included in this contract. (2) [Reserved] (b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Internet Payment Platform (IPP). Information regarding IPP is available on the Internet at www.ipp.gov. Assistance with enrollment can be obtained by contacting the OPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131. (c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing. (d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer's written authorization with each payment request. (End of clause) (d) The DTAR Provision 1052.209-71, Certification Regarding Responsibility Matters - Class Deviation Representation by Corporation regarding an Unpaid Delinquent Tax Liability or a Felony Conviction under Federal Law (Feb 2012) is attached. Offerors must submit a completed and signed copy with their offer to be considered for award. (xiv) The Defense Priorities and Allocations System (DPAS) is not applicable. (xv) Offers must be submitted in Microsoft Word (.doc/.docx), Microsoft Excel (.xlsx/.xls) or.pdf format and emailed to Aleta Dust at Aleta.dust@irs.gov by 2:00pm ET 13 Feb 2015 to be considered for award. (xvi) Questions regarding this solicitation must be emailed to aleta.dust@irs.gov by 5:00pm ET 9 Feb 2015 to be answered. The Government intends to answer timely questions within two business days after.
