Description
The Pretrial Services Agency (PSA), Office of Forensic Toxicology Services (OFTS) recently acquired three Beckman-Coulter AU-5800 analyzers. The initial acquisition provided for specialized training for up to six OFTS staff members; However, training is required for additional staff. This notice provides justification for acquiring specialized training for the additional agency personnel on a non-competitive (sole source) basis directly with Beckman-Coulter in an anticipated Firm Fixed Price Contract. Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.301 and 6.303, the justification for the use of the statutory authority cited below is justified by the following facts and rationale. (1) Contracting Activity: This Justification for Other than Full and Open Competition (JOFOC) is issued by: Pretrial Services Agency for the District of Columbia Office of Finance and Administration / Procurement 633 Indian Avenue, NW Washington, DC 20004-2908 (2) Nature and/or description of the action being approved: The Pretrial Services Agency (PSA), Office of Forensic Toxicology Services (OFTS) recently acquired three Beckman-Coulter AU-5800 analyzers. The initial acquisition provided for specialized training for up to six OFTS staff members; However, training is required for additional staff. This document provides justification for acquiring specialized training for the additional agency personnel on a non-competitive (sole source) basis directly with Beckman-Coulter. (3) Description of the supplies or services required to meet the agency's needs (including the estimated value): Contractor will be required to provide hands- on training on the use and operation of the Beckman-Coulter AU-5800 Analyzer for eleven (11) staff members. This training shall be at the contractor's facility. The contractor shall provide the following for the 11 staff members: air travel to the training facility, lodging/hotel, three meals a day, transportation upon arrival to the hotel and upon departure to the airport. The contractor shall also provide daily round trip transportation to the training facility for the 11 staff members. Contractor shall provide training materials: books, training manuals and other consumables for the 11 staff members. The contract will include the price of training, travel, lodging, and meals. (4) Statutory authority permitting other than full and open competition: 41 U.S.C. 253(c)(1); FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. (5) Demonstration that the contractor's unique qualifications or the nature of the acquisition requires the use of the authority cited: Beckman- Coulter is the exclusive manufacturer, proprietor and distributor of AU 5800 analyzer in the U.S. Beckman-Coulter is the only manufacturer that provides training on the AU 5800. Beckman- Coulter partners with Siemens exclusively. Training can only be provided by Beckman-Coulter or authorized partners such as Siemens by Beckman's standards. (6) Efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: The agency shall post its intent to sole source on the Federal Business Opportunities (FBO) portal for a minimum of 30 days. (7) Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: The contracting officer shall use price and/or cost analysis to determine price reasonableness. (8) Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Research shows that only Beckman -Coulter is authorized to provide training in the AU 5800 analyzers. (9) Other facts supporting the use of other than full and open competition: None (10) Sources that expressed, in writing, an interest in the acquisition: None at this time. (11) Actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: None. The agency does not anticipate the need for subsequent acquisitions.
