Description
INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Consolidated Station Support and Simplified Acquisitions (CSS/SA) Branch intends to negotiate and award a purchase order to Rapp OptoElectronic GMBH for an uncaging/optogenetic system without providing for full and open competition (including brand-name). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard of 500 Employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-78 dated December 26, 2014. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the authority of FAR Subpart 13.106-1. DESCRIPTION OF REQUIREMENT Purpose and Objectives The purpose of this procurement is acquisition of one Rapp Optoelectronic GmbH uncaging/optogenetic system for the National Institute on Drug Abuse (NIDA) Intramural Research Program (IRP) Synaptic Plasticity Section (SPS). This equipment will be used to upgrade a Rapp Optoelectronics Model No. Olympus BX51WI Microscope owned by the NIDA IRP and used for electrophysiological research studies. Only Rapp Optoelectronics equipment upgrades are acceptable to ensure continued full function of owned equipment which is proprietary to its original equipment manufacturer. Project Description Specifically, the NIDA IRP SPS requires a Rapp Optoelectronic GmbH Galvanometer Scanner-Based Uncaging and Optogenetics System as follows: 1. One (1) UGA-42-Geo combo point and selectable spot shape combination system 2. One (1) DL-375nm/200mW turn-key, software-controlled laser system 3. One (1) Speckle Reducer. 4. FOB Destination Delivery 5. Installation and Training To ensure continuity of science and continued full function of owned proprietary equipment, only a Rapp Optoelectronics Galvanometer Scanner-Based Uncaging and Optogenetics System is acceptable. Delivery/Period of Performance It is expected that the above described project requirements will be delivered within four (4) months after contractor receipt of award. A firm fixed price purchase order is anticipated. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, only Rapp Optoelectronic GmbH is capable of meeting the needs of this requirement because the microscope requiring additional capabilities to advance research studies is proprietary to this company, the original equipment manufacturer. Due to the proprietary nature of the Rapp Optoelectronic GmbH Microscope Model No. Olympus BX51WI, use of any other contractor's systems for upgrade purposes is impossible as it would result in upgrade failure and may jeopardize the integrity of the owned equipment. Such an attempt would also negate equipment warranties remaining for the Model No. Olympus BX51WI Microscope. Non-functional upgrades and possible damage to the owned equipment would be critically detrimental to the NIDA IRP studies. As such, only Rapp Optoelectronics can provide the required software and hardware upgrades. Further, only a galvanometer system from Rapp Optoelectronic GmbH is acceptable to upgrade the owned microscope to ensure continuity of scientific research. The NIDA IRP conducts a number of state of the art studies that utilize significant quantities of data from the Model No. Olympus BX51WI Microscope and these studies now require additional technology for continuation. The data already acquired using the owned microscope is highly sensitive to the proprietary parts and software of the OEM-proprietary equipment. Accordingly, no technology other than a Rapp Optoelectronics galvanometer system being added to the existing system will allow the already-acquired research data to continue to be viable and relevant to new data. For these many reasons, Rapp Optoelectronic GmbH is the only contractor capable of meeting the needs of this requirement. CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by the closing date and time of this announcement and must reference the solicitation number.
