Description
In accordance with FAR 5.203(b)(d) and 6.302-1 the National Park Service intends to award a purchase order on the basis of other than full and open competition for Olympic National Park to purchase ten point of sale (POS) cash registers (hardware only - no software), as replacement units for older equipment. This notice of intent is not a request for competitive quotations. No solicitation document exists at this time. The North American Industry Classification System (NAICS) code is 334118 and the small business size standard is 1,000 employees. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement, proposal, or quotation within fifteen (15) calendar days after date of publication of this synopsis which will be considered by the agency. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FOR SIMPLFIED ACQUISITIONS OVER $3,000 UP TO $150,000 as follows: Date: 03/04/2015 Purchase Request Number: 0040192424 1. DESCRIPTION OF THE ACTION BEING APPROVED: National Park Service, Olympic National Park intends to award a non-competitive purchase order to Advantage Solutions, LLC in the amount of $53,892.13 for the purchase of twelve brand-name Point of Sale (POS) cash registers (Datasym Elixr Duo Touch Screen), including associated equipment, installation, and programming. 2. AUTHORITY: a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. b. FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs. c. FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 3. DESCRIPTION OF THE PRODUCT'S UNIQUE QUALIFICATIONS OR THE UNIQUE NATURE OF THE ACQUISITION: Olympic National Park's current POS equipment is 10-12 years old and in need of repair to many different components of the system. The current POS equipment is no longer manufactured, so replacement parts are becoming increasingly difficult to find. Several registers at different locations around the park had equipment components fail last summer. The purchase of the Datasym Elixir Duo Touch Screen cash registers will allow the Olympic National Park fee program to (a) maintain its existing POS software programs (Comm2000 and Advantage, created and licensed by Advantage Solutions and not sold to any other company or manufacturer), (b) replace aging equipment (such as cash registers, credit card modems, etc.), and (c) maintain compatibility with existing tracking and deposit software, currently being used at all ten of our POS in the park. The Advantage Solutions' Comm2000 and Advantage software was created and licensed by Advantage Solutions, not sold to any other company or manufacturer, and was designed specifically for the NPS fee program; used for depositing, tracking, auditing, numerous report preparations and retrieval, all which increase program accountability that allows effective management of the funds. 4. MARKET RESEARCH. PLEASE EXPLAIN THE RESULTS OR WHY ONE WAS NOT PERFORMED. STATE WHETHER ANY OTHER OFFERS WERE RECEIVED OR ANYONE EXPRESSED INTEREST: While there are other Datasym authorized dealers that sell the Datasym Elixr Duo Touch Screen cash registers, at this time there are no other POS software providers who have developed a system for sales of National Park Passes with the ability to track the sales and provide back office remittance and deposit software specific to the needs of National Parks. The Washington Fee Office is exploring other systems but to date have no recommendations and have not elicited any other sources for our needs. The NPS Washington National Fee Program is currently developing a nation-wide standard for hardware and software point of sales equipment that's planned to be implemented over the next few years. Any new POS system purchased now would have potential of not being compliant with the national standard, and could potentially cost $80,000 or more. Olympic National Park does not have sufficient budget that would support purchasing all new equipment and software required for a new POS system, therefore the decision to only purchase the replacement of the cash registers at this time that are compatible with existing POS software was determined to be in the Government's best interest and the most economical option. 5. IF THIS IS A DETERMINATION FOR SOLE SOURCE, THE CONTRACTING OFFICER CERTIFIES: a. Only one source is available, or urgent and compelling circumstances exist. b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a). 4. IF THIS IS A DETERMINATION FOR SOLE SOURCE, THE CONTRACTING OFFICER CERTIFIES: a. Only one source is available, or urgent and compelling circumstances exist. b.
