- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Contracting Activity: Department of Veterans Affairs, VISN 23, VA Health Care Systems. NCO23 Black Hills Contracting office 113 Comanche Rd. Bldg. 46 Fort Meade SD. 57741 2237 # 618-15-3-3308-0165 2. Nature and/or Description of the Action Being Processed: This is a fixed price, sole source, contract for 6 months, with 1 six month option for (LEC services for the Medical Center, Outlying Buildings, CBOC's, and Vet Center). FAR Part 6.302-1. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Contractor must provide Basic (LEC) services at each location of service to include Plain Old Telephone Service (POTS), Frame Relay, ISDN PRI, DSL, DS1/T-1, Ethernet, Token Ring, DS3/OC-1, Fast Ethernet, and DS3/T-3D for both the inter and intra data locations in addition to all specifications of the statement of work (SOW) from 10/1/14-9/30/15. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.302. (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): These services are currently under transition to a National Contract which will administer all current LEC contracts. Information has been collected from all VA's nationally for all services provided by current contractors and submitted through a LEC Data Call. Any changes to services provided or service providers, could delay the National Contract solicitation process. Switching to another provider at this time would take weeks to months to transition fully and would require resubmitting new data to be incorporated into the new National Contract requirements. Also, a change in providers at this time exposes the facility and all other sites to the risk of inadvertent outages that may impact patient safety. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No efforts have been made. All LEC contracts will be switching to a National Contract. Any changes to services provided or service providers, could delay the National Contract solicitation process. Switching to another provider at this time would take weeks to months to transition fully and would require resubmitting new data to be incorporated into the new National Contract requirements. Also, a change in providers at this time exposes the facility and all other sites to the risk of inadvertent outages that may impact patient safety. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Contracting Officer will determine price fair and reseanobaleness. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted via FSS Schedule, GSA Advantage and via internet searches. In an attempt to find other vendors who can bring a lower competitive price for the same service required by the statement of work, however I could not locate any such vendors. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: These services are currently under transition to a National Contract which will administer all current LEC contracts. Information has been collected from all VA's nationally for all services provided by current contractors and submitted through a LEC Data Call. Any changes to services provided or service providers, could delay the National Contract solicitation process. Switching to another provider at this time would take weeks to months to transition fully and would require resubmitting new data to be incorporated into the new National Contract requirements. Also, a change in providers at this time exposes the facility and all other sites to the risk of inadvertent outages that may impact patient safety. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: We have no additional sources that expressed any interest. Due to the National contract we did not bid this out. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There are no actions that can be taken at this time. Again, there is only 1 (one) authorized vendor. 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
