Description
Solicitation N00189-14-R-Z076 resulted in the sole source contract award N00189-15-D-Z021 to WR Systems LTD. Below is the Justification and Approval document. The contracting activity is the Fleet Logistics Center (FLC), Norfolk, Contracting Department, Philadelphia Office. 2. DESCRIPTION OF ACTION BEING APPROVED: This is a sole source action to be awarded as a new contract to WR Systems, Ltd. of Fairfax, VA on a sole source basis for the services identified in paragraph 3 below. 3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The Forces Surveillance Support Command (FSSC), Chesapeake, VA, requires contractor support services in support of the Relocatable Over-the-Horizon Radar (ROTHR) system Program Office (RPO) at FSSC. The ROTHR System is a very unique radar system that uses high-frequency (HF) over-the-horizon (OTH) radar to track and detect drug trafficking activities in Northern South American and Caribbean and Gulf of Mexico basins. It is used by the Navy, North American Defense (NORAD), Customs, Drug Enforcement Agency (DEA), and other national security agencies for Homeland Security, Counter-Narcoterrorism and Anti-Terrorism activities. The FSSC RPO, whose mission it is to support ROTHR system operations, acts in all activities associated with support of the ROTHR System, including hardware/software configuration management, upgrade installation and Installation Verification and Validation (IV and V), system enhancement development, system performance diagnostics, Pre-Program-Product-Improvement (PPPI), ROTHR non-procurable parts re-engineering, ROTHR system logistic support, ROTHR-related budget and cost/benefit support, ROTHR system development, execution and upgrade, and coordination of ROTHR System improvements with international Over-the-Horizon Radar (OTHR) system efforts and other functions. The FSSC RPO requires contractor services in support of this RPO mission. Support services include highly specific Scientific, Engineering and Technical Assistance (SETA) services, programmatic, and fiscal support services. The primary places of performance for work under this contract include the Southside Hampton Roads (Chesapeake, Norfolk) and Fairfax, Virginia, Texas, and Puerto Rico. Other performance locations may include, but not necessarily limited to Sudbury, MA; Washington, D.C.; Australia; Colombia, South America; and Key West, FL. The placement of an Indefinite Delivery, Indefinite Quantity (IDIQ), Cost-Plus-Fixed-Fee (CPFF), Performance-Based type contract that will allow the placement of task orders tailored to the nature of specific, individual requirements is anticipated for a four year ordering period beginning on 15 April 2015. 4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY: The ROTHR System is a very unique, one-of-a-kind system in the United States, who s long-range, land-based, wide-area surveillance system reliably detects aircrafts and surface ships within designated surveillance zones off the U.S. coastline. ROTHR has been supporting the U.S. Government s counter drug mission in the Caribbean Sea and in South American for more than 20 years. ROTHR is based on an extremely complex technology that uses the Earth s ionosphere to reflect/refract radar signals over extraordinary distances. Unlike conventional radar, which is often hampered by range and altitude restrictions, ROTHR can identify and track suspicious air and sea traffic from far away, helping authorities follow and intercept the Go-Fast Boats and small aircraft favored by international drug smugglers. Each of the three (3) ROTHR Systems operates 24/7/365 and detects in excess of 350,000 targets per year. The application and integration of this technology is absolutely critical in support of the U.S. Counter Narcoterrorism and Homeland Security initiatives. ROTHR is currently the U.S. Government s primary surveillance system for the counter drug mission. WR Systems, Ltd is the only company with the knowledge and expertise to support this very unique system in accordance with the requirements of this solicitation. The company forms the foundation of a significant national resource in the field of Over-The-Horizon-Radar (OTHR) technology, an expertise for which the company is internationally recognized. WRSystems has been involved with SETA support of the ROTHR program for over 15 years, its staff is often referred to as the gray beards for its tenure in working with the ROTHR system since its inception in the early 1980 s. The unique expertise of WRSystems ensures effective technology integration and logistic support of this very unique ROTHR system. No other company possesses this cradle-to-grave knowledge of the specific ROTHR System, with the exception of the Original Equipment Manufacturer (OEM), Raytheon Company Integrated Defense Systems (Raytheon IDS). Furthermore, it is considered an Organizational Conflict of Interest (OCI) for Raytheon IDS to provide the required RPO support services because Raytheon IDS currently provides support under FSSC s ROTHR System Engineering Support Contract. The role of the RPO support contractor is, in a sense, at odds with the role of the OEM/System Engineering contractor. The RPO support contractor will have access to all FSSC s budgetary data and will be tasked with developing ROTHR requirements and tasking related to the OEM s contract. Additionally, the RPO support contractor will be involved in Independent Verification and Validation (IV and V) as well as Test and Evaluation (T and E) of the OEM s products under the System Engineering Support Contract. The Government requires a separation of these different facets of the ROTHR Program to ensure objectivity and impartial judgment. In accordance with FAR 9.505-1 on Providing Systems Engineering and Technical Direction: in performing these activities, a contractor occupies a highly influential and responsible position in determining a system s basic concepts and supervising their execution by other contractors. Therefore this contractor should not be in a position to make decisions favoring its own products or capabilities. It is, therefore, considered a significant OCI for Raytheon IDS to perform these RPO support services, as they will absolutely have a direct impact on the OEM s system and Raytheon IDS s System Engineering Contract. The checks and balances, which WR Systems offers the FSSC ROTHR team, are necessary for the Program to function properly. 6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE: The synopsis for the current contract# N00189-12-C-Z039, stating the intent to solicit on a sole source basis, was posted on 29 June 2011. Only one response was received from industry. The company, Space and Defense Engineering Services Company, LLC, indicated their interest in the requirement. Review of the provided capabilities statement and the company s website did not demonstrate the required specialized capabilities, nor experience. The instant acquisition was synopsized in the Navy Electronic Commerce Online site (NECO) at https://www.neco.navy.mil/buyer/ on 10 July 2014. To date, no potential sources have identified an interest in this acquisition effort. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than WRSystems to provide the required services. 7. DETERMINATION OF FAIR AND REASONABLE COST: The Contracting Officer will determine that the prices/costs negotiated for this acquisition are fair and reasonable in accordance with FAR Part 15. 8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: For the reasons set forth in Paragraph 5, FLC Norfolk Contracting Department, Philadelphia Office has no plans at this time to compete future contacts for the types of services covered by this document. 9.
