- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price and extend the period of performance to purchase order SB1341-14-SE-0126, on a sole source basis, with JEOL USA of Peabody, MA for the service maintenance agreement for a JEOL JBX-6300 electron beam lithography system under other than full and open competition by the authority of FAR subpart 6.302-1. The existing contract expires April 30, 2015 and it is NIST's intent to extend the Period of Performance for an additional 3-months through July 31, 2015. The extension will be performed under the same terms and conditions as the existing contract. The three month extension will ensure that no break in the availability of service and maintenance will exist, while allowing the Government adequate time for the follow-on award. As the sole service provider, JEOL USA possesses a complete history of the equipment and a thorough understanding of NIST's specific needs and requirements. The experience and expertise possessed by JEOL USA is essential, as the instrument subject to the service agreement is a complex device containing multiple components that must integrate and work seamlessly together. Further, JEOL is the manufacturer of all hardware and software within the instrument and therefore is the only source of proprietary components required for any necessary repair. JEOL USA employs, trains and certifies all field service technicians and engineers qualified to provide the required service and maintenance. JEOL USA does not train, certify or license other vendors to perform services on JEOL JBX systems. The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $19 Million dollars. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on April 16, 2015. Inquiries will only be accepted via email to Melissa.Schroeder@nist.gov. FOR THE PURPOSE OF SUBMITTING RESPONSES BY EMAIL, THE SIZE LIMIT IN A SINGLE E-MAIL IS 25 MB. No mailed, telephone or fax requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
