Description
The 10th Contracting Squadron, United States Air Force Academy (USAFA) Colorado intends to make a Sole Source award to ESRI, Inc. for the purchase of a campus-wide higher education license for use and maintenance of ESRI ArcGIS Geographic Information Systems (GIS) software for a period of 12 months (1 July 2015 - 30 June 2016). This procurement is for the acquisition of a sole source commercial item using simplified procedures in accordance with FAR Parts 12 and 13. The North American Industrial Classification System (NAICS) number is 511210 and the business size standard is $38.5 million. Requirement: Material Number 106602, ESRI Unlimited Educational Site Enterprise License and Maintenance (1 July 2015 - 30 June 2016). The Higher Education Licensing includes Virtual Campus courses, Annual User Conference attendance passes, technical support, ArcGIS publications, training, ArcGIS Online Enterprise Account (Cloud based GIS specifically for USAFA - this is already in use by many AFA instructors and cadets), and the software includes software developer tools and API, ArcGIS server software, ArcGIS software, all ArcGIS extensions, ArcGIS engine, ArcGIS Defense Solutions, ArcGIS Business Analyst and Aviation software. The Higher Education Licensing provided unlimited seats of certain software for both floating and stand-alone licensing. Sole Source Justification: Only one responsible source and no other item will satisfy the USAFA requirement. ESRI, Inc. is the only approved source for the, ESRI Unlimited Educational Site License. The ESRI Higher Education software was originally purchased as part of the DFEG curriculum development in the use of geographic information systems and geospatial analysis, but the use of GIS has now proliferated throughout the Dean of Faculty (DF) and USAFA. Countless man hours have been used to develop course material, content and lessons based around ESRI ArcGIS. This software suite is now critical to the Academy education mission with the vendor providing technical support and updates. This is the primary GIS software used in upper level courses in geoscience, biology, civil engineering and computer science classes. The ESRI GIS software is also in use by the 10th CES, AFA Air Field, and other 10th ABW organizations. Because this is the software of choice by the USAF world- wide, it will be used by all cadets at some point in their academics at USAFA and in their careers with the Air Force as officers. All software is copyright protected. A typical software license grants an end-user permission to use unlimited copies of software. The ESRI has proprietary rights to this software and directly provides all upgrades, patches, and releases for the software, and all technical support. The main characteristic of proprietary software licenses is that the software publisher grants a license to use the software, but ownership of those copies remains with the software publisher. One consequence of this feature of proprietary software licenses is that virtually all rights regard ing the software are reserved by the software publisher. Authorized third-party providers of the software are not allowed to provide the license and maintenance support. Award of this contract to another company is not possible, and lack of maintenance will jeopardize the performance of this critical mission. For the reasons stated above, product licenses and upgrades must be brand name specific. In this case, only one source (ESRI) is able to provide software maintenance requ ired. Alternative GIS software is limited and in some cases cumbersome to operate. Developing several courses and curriculum around another GIS software that is not aligned with USAF GIS software use and practices is impractical and will place graduating cadets that used alternative GIS software at a disadvantage. This synopsis is for notification purposes only and does not constitute a solicitation for bids or proposals. DO NOT submit a bid/quote at this time. Any offerors believing they can provide the required ESRI ArcGIS Unlimited Educational Site License with all specifications of the requirement described above may provide evidence for consideration. Evidence must support the offeror's claim. All qualified sources may submit a response, which if timely received, will be considered by this agency. Information received will be considered solely for the purpose of determining whether a competitive procurement can be conducted. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. Responses must be received NLT 10:00 AM Mountain Daylight Time (MDT) on 29 July 2015. Responses received after this will be considered late IAW FAR 52.212-1(f) and will not be evaluated. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
