Description
Statement of Work (SOW) - OIA369 FBO Title: Fleet Data Subscription Notice No.: HSTS02-15-Q-OIA369 Set Aside: N/A, Full and Open NAICS: 518210 (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation No: HSTS02-15-Q-OIA369 (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-82. (v) A list of contract line item number(s) and items, quantities and units of measure, (including option(s), if applicable) : CLIN 0001 Base Period (2015 -2016 subscription year) $ CLIN 1001 Option Period 1 (2016 -2017 subscription year) $ CLIN 1002 Option Period 2 (2017 -2018 subscription year) $ CLIN 1003 Option Period 3 (2018 -2019 subscription year) $ CLIN 1004 Option Period 4 (2019 -2020 subscription year $ (vi) Description of requirements for the items to be acquired: The contractor shall provide airline fleet data, delivered on a weekly basis in the format described in the attached SOW. Additional requirement details may be found in the attached SOW. (vii) Date(s) and place(s) of delivery and acceptance and FOB point. Please see SOW. (viii) The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. All Questions are due via email to Shaunte.Chacon@tsa.dhs.gov on June 30, 2015 at 2:00 PM EST. Responses to questions will be received prior to the proposal due date. The provision at 52.212-2, Evaluation -- Commercial Items, does not apply. The source selection process used will be based on a selection of the technically acceptable proposal with the lowest price (LPTA). The contractor shall provide a sample file which is representative of the file to be provided in the subscription. The contractor shall post the sample data to a HyperText Transport Protocol Secure (HTTPS) site. The Government must be provided access with instructions to the HTTPS site, including login and password. This sample file will be evaluated to determine technical acceptance. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (41 U.S.C. 3509).
