Description
J&A N00173-13-C-2001 P00004 with Signatures Justification for Other than Full and Open Competition The Department of the Navy, contracting through the Naval Research Laboratory (NRL), proposes to enter into a contract on the basis of other than full-and-open competition with Hypercomp Engineering Inc (HEI), for the safety certification of high pressure hydrogen and oxygen tanks. The additional work mainly requires additional testing of the tanks developed under N00173-13-C-2001. 1. Nature and/or description of the action being approved. Hypercomp Engineering Inc (HEI) has successfully developed high-pressure hydrogen and oxygen gas tanks under NRL contract N00173-13-C-2001. New intellectual property was developed in the process, and the gas tanks are unique. The tanks now must be tested to prove that they meet a national safety certification code so that they can be used in NRL/ONR prototype undersea vehicles. The proposed effort is to carry out testing to achieve Department of Transportation (DOT) safety certification of the gas tanks. The testing is typically destructive and mainly requires HEI to build the tanks designed under contract N00173-13-C-2001 and test them. 2. Nature and/or description of the supplies/services required to meet the needs of the Naval Research Laboratory Hypercomp Engineering will carry out testing on the tanks designed in accordance with DOT regulations to determine that their high-pressure hydrogen and oxygen gas storage tanks meet national code. The testing requires building numerous tanks, and then determining the points at which the tanks can be destroyed. Typically, the tanks must be able to withstand pressures of 2.25x over their design point before they fail. The testing must be witnessed by a DOT-certified official and documentation is required to prove that the testing was carried out successfully. For the certification to be valid, the testing must be carried out on the exact tanks developed under contract N00173-13-C-2001. Substitutions are invalid, and the tanks must be made precisely how they are being made by HEI for the DOT approval to be valid. 3. Delivery requirements and required delivery dates. The effort will produce two reports and a safety certification, but no hardware. The safety certification is requested for 12 months the after award date to meet the broader program schedule. 4. The total estimated dollar value (including all options) for the acquisition(s) covered by this justification. $600,000 5. Identification of statutory authority permitting other than full and open competition. 10 U.S.C. 2304(c)(1) and FAR 6.302-1 -Only One Responsible Source 6. Demonstration that proposed contractor's unique qualifications or nature of the acquisition requires the use of the cited authority. HEI built the tanks for N00173-13-C-2001 and are best qualified to build the tanks needed for safety certification. For another company to carry out the DOT certification of the HEI tanks from N00173-13-C-2001, they would either (1) have to purchase all the tanks from HEI and then carry out independent testing, or (2) transfer all the intellectual property from HEI to a new company. Either scenario is highly inefficient. By having HEI do all the testing, they can also proposed to DOT that they reuse some of the test data already developed under N00173-13-C-2001 toward the safety certification. 7. A description of efforts made to ensure offers are solicited from as many potential sources as is practicable including whether a FBO notice was or will be publicized NASA was willing to carry out the DOT testing. In this case, HEI would build all the tanks, and then NASA would negotiate with DOT and carry out all the testing. NASA assessed that it would be more efficient for HEI to do the DOT certification. 8. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer will perform a price analysis in accordance with FAR 15.8052(a)-(e) (and cost analysis, if required) to determine whether the price is fair and reasonable. 9. Description of the market research conducted Market research could not be done without transferring HEI intellectual property to that company. 10. Any other facts supporting the use of other than full and open competition. 10.1 Acquisition Plan Not applicable. 10.2 Automatic data processing (ADP) requirements. Not applicable. 10.3 Spare Parts Not applicable. 11. A listing of sources, if any that expressed in writing, an interest in the acquisition. None. The original contract was bid out by NRL, and HEI was the only company to complete the contract competition. 12. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The request for DOT certification could have been included in the original statement of work, which would have allowed another vendor to possibly have a lower cost development and certification process than proposed by HEI.
