Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, quote mark Streamlined Procedures for Evaluation and Solicitation for Commercial Items, quote mark as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-82, Department of Defense FAR Supplement DPN 20150602, and Army FAR Supplement #26, 31 March 2015. This solicitation and resultant contract is conducted as a 100% small business set aside under NAICS code 811219 and the associated small business size standard is $20,500,000.00. All responsible sources may submit an offer which shall be considered by the government. The Western Regional Contracting Office, EACH Contracting Cell, Fort Carson, CO is seeking to purchase a full service maintenance and repair contract for a variety of makes and models, 72 microscopes located at the Evans Army Community Hospital, Fort Carson, Colorado. The following solicitation provisions apply to this acquisition: a.FAR 52.212-1, quote mark Instructions to Offerors-Commercial Items quote mark (April, 2014) applies to this acquisition and the following addenda is provided. Addendum to 52.212-1: This procurement is for a full service, on-site preventive maintenance and repair service of 72 microscopes from a variety of vendors. The requirement is an all or none requirement, in that the company must be authorized to perform maintenance service on all microscope makes listed in the Performance Work Statement. Only those bidders who can perform maintenance on all, not partial, microscopes will be eligible for award. The PWS list of all microscopes under this procurement. Per the PWS, as the Government's needs change, other microscopes may be added or deleted from the listing during the life of the contract. Per the PWS, all repairs shall be covered by a repair guarantee. Vendors shall be an Original Equipment Manufacturer (OEM) authorized repair facility for the microscopes such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty, and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. Offerors are required to submit documentation from the manufacturer stating that they are an authorized repair service for the specific items being procured. The offeror must provide documentation or statement stating they can perform maintenance on-site and meet the response times required by the PWS. Paragraph 52.212-1(c), Period for Acceptance of Offers. Replace with the following: Government Minimum Acceptance Period. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers. The Government will not consider offers providing less than 90 calendar days for Government acceptance. Paragraphs 52.212-1 (d), (e), (h), (i) are deleted. Paragraph 52.212-1(m), Filing of Agency Protest. Add the following: Protests received at a level higher than the contracting officer will be referred to the contracting officer. Protestor may request a review by the contracting officer or an independent review at a level higher than the contracting officer. Requests for appeals or independent review will be addressed to the contracting officer for referral to the review authority. Questions on this process will be referred to the contracting officer identified in the solicitation. Paragraph 52.212-1(n). The non-FAR Part 12 discretionary FAR, DFARS, AFARS, and MEDCOM provisions included herein are incorporated into this solicitation either by reference or in full text. If incorporated by reference, see provision 52.252-1 for locations where full text can be obtained. b. The provision at 52.212-2, Evaluation -- Commercial Items, applies to this acquisition. The specific evaluation criteria to be included in paragraph (a) are as follows: (a) Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest evaluated price of proposals whose technical approach is determined to be quote mark acceptable quote mark. The offeror shall provide their documentation showing company is authorized to work on the required OEM equipment, statement company can meet the response times as required by the PWS, and demonstrate their ability to perform all maintenance on-site at Evans Army Community Hospital. These three items are considered the technical approach. The technical approach provided will be evaluated as quote mark acceptable quote mark or quote mark unacceptable quote mark. Award will then be made on the basis of the lowest evaluated price of quotes with technical acceptability standards. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary. Offerors with no relevant past or present performance history shall be treated neither favorably nor unfavorably. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
