- Master BPA CLASS JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION Contracting Activity Naval Surface Warfare Center, Corona Division (NSWC, Corona) Contracts Department, Code 02. Description of the Action Being Approved This class justification and approval authorizes the award of a sole source Basic Purchase Agreement (BPA) to Rohde & Schwarz USA, Inc. 8661A Robert Fulton Drive Columbia, MD (CAGE: 82199) for the calibration of the Rohde and Schwarz Microwave Measuring Receiver P/N FSMR-26N and its associated power sensors P/N NRPZ51 and P/N NRPZ52. This action is being implemented for the Naval Air Systems Command (NAVAIR), in support of the Metrology and Calibration (METCAL) Program at the Naval Air Systems Command, Patuxent River, MD. Description of Supplies/Services The NAVAIR METCAL Program has a requirement for calibration services of the previously purchased Rohde and Schwarz Microwave Measuring Receiver P/N FSMR-26N and its associated power sensors P/N NRPZ51 and P/N NRPZ52 using NAVAIR METCAL FY14 Aircraft Procurement, Navy (APN)-7 Operations and Maintenance, Navy (OMN) Funding for services to support Naval Aviation Fleet Intermediate Calibration Activities, Fleet Training Activities, and Navy Calibration Laboratories. The period of performance of the BPA shall be five (5) years from date of award. These requirements shall be Firm Fixed Price (FFP). The total estimated value of the contract is $1,819,350 and will be funded with APN funds. Statutory Authority Permitting Other Than Full and Open Competition 10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements in accordance with FAR 6.302-1. Rationale Justifying Use of Cited Statutory Authority Contract N63394-11-D-5062 was a competitive procurement in which Rohde & Schwarz was the successful offeror. Rohde & Schwarz modified a commercial unit (FSMR-26) to produce the Navy required commercial modification, P/N FSMR-26N. Rohde & Schwarz is the original designer, developer and manufacturer of the Microwave Measuring Receiver P/N FSMR-26N and its associated power sensors P/N NRPZ51 and P/N NRPZ52 and is the only source with the requisite knowledge, experience and technical expertise to provide the calibration services necessary to complete the calibration and return units Ready for Issue (RFI). The guidance in DFARS 227.702-1(a) states DoD shall acquire only the technical data customarily provided to the public with a commercial item or process, except technical data that describes the modifications made at Government expense to a commercial item or process in order to meet the requirements of a Government solicitation. As such, the Government did not acquire the data rights or technical information that is required to complete this effort in-house. To procure the calibration services from another source, would require that source to obtain the Rohde & Schwarz technical data rights. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable A Special Notice synopsis expressing the Governments intent to sole source this requirement was posted 18 November 2014 on the Federal Business opportunities (FEDBIZOPS) website. To date, no responses have been received. Additional Market Research outlined below indicates that no other manufacturers produce the required calibration standards being procured. Market research using web-based searches including GSA advantage, Haystack, Google, Bing, and System for Award Management (SAM) did not reveal any sources for the requested service other than the Original Equipment Manufacturer. No 8(a) or other sources were found that could provide the required model numbers. Determination of Fair and Reasonable Costs The Contracting Officer has determined that the anticipated cost to the Government for the services covered by the J&A will be fair and reasonable. The Contracting Officer will use cost and price analysis, including historical cost estimating relationships from previous procurements, to determine that the final price to the Government is fair and reasonable. Detailed cost and/or pricing data will be requiredand will be certified by the contractor at the conclusion of negotiations. Actions to Remove Barriers to Future Competition The primary standard being supported by this service procurement is the FSMR-26N which was introduced to the fleet by competitive five (5) year Indefinite Delivery Indefinite Quantity (IDIQ) contract # N63394-11-D-5062 and a production order in 2012. The estimated lifetime of this standard is ten (10) years in the fleet. In ten (10) years, 2021, or when the current standard the FSMR-26N is no longer procurable or when accuracy requirements change, and/or when overall modernization is required new standards will be evaluated for suitability and future procurements considered.
