- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Aging, Intramural Research Program intends to negotiate and award a Purchase Order without providing for full and open competition (Including brand-name) to Meso Scale Discovery, 1601 Research Boulevard, Rockville, MD 20850 for the Phospho IRS Whole Cell Lysate Kits. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 423460-Ophthalmic Goods Merchant Wholesalers with a Size Standard of 500. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-83, dated August 5, 2015. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Phospho IRS Whole Cell Lysate Kits Background - The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency whose mission is to seek fundamentals knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life and reduce illness and disability, conducting, supporting and making medical discoveries that improve people's health and save lives. NIA, one of 27 institutes, leads the federal government in conducting and supporting research and aging and the health and well-being of older people. The Institute seeks to understand the nature of aging and the aging process and disease and condition associated with growing older in order to extend the healthy, active years of life. Purpose and Objectives The purpose of this requirement is the purchase of Phospho IRS Whole Cell Lysate Kits. Period of Performance 60 days after receipt of contract award Contractor Requirements The contractor shall provide and deliver the following: (1) Phospho IRS-1 Whole Cell Lysate Kit (5 P1); (2) Phospho IRS-1 Whole Cell Lysate Kit (20 P1); (3) Multi spot - 4 spot special order human 4 plex; (4) 96 well 4 spot prototype Phosphorprotein Triplex; (5) shipping and handling. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, through the sources sought notice published in the FedBizOpps on July 27, 2015, HHS-NIH-NIDA-SSSA-SBSS-2015-465 for Whole Cell Lysate Kits and pursuant to FAR Subpart 13.106(b) Soliciting from a single source, the contracting officer has determined that circumstances of the contract action deem only one source reasonably available. Only Meso Scale Discoveries supplies pre manufactured high through assay kits for detection of neurodegeneration markers. These assays kits are compatible only with existing government owned equipment. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must include unit price, extended price, percentage discounts, shipping, freight, installation, and training cost as applicable.
