- JUSTIFICATION AND APPROVAL (J&A) FOR O T H E R T H AN FULL AND O PEN C O MPETITION 1. The Office o f Acquisition Manag e ment is cond u ct i ng this acqu i siti o n for Gemalto licenses on behalf of IRM / OP S IITI / SI. 2. Nature and/or description of the action being a p p roved G e m alto products for enhanced s e cu r ity in su p port of the D e part m ent's PKI p r ogram. 3. A description of the supplies or s e rvi c es re q uired to meet the Department's need s. The Department has an immediate need to combat the persistent and continuing attack a g a inst its n e tw ork. This software w i ll pro v ide the additional lo g - on security re q ui r e m ents for local syst e ms administrators as m and a ted by HS P D-1 2. The PKI program will use the Gemalto pr o du c ts and support as an additional security c o mpon e nt that will assist with va l i dation of log on cred e nti a ls. 4. An identification of the st a tutory author i ty per mitting oth e r t h an full and open c om p eti t io n. 41 USC 253(g) a n d FAR 13.106(b), On1y One Responsible Source (Brand Name) 5. A demonstration that the proposed c on t ractor's unique qua l ifications or the nature of the acquisition requires use of the author ity c i te d. Gemalto will only pr o vide support for prod ucts purchased from G e malto and authorized resellers. Maintenance of this product is required to ensure that any p r o blems with the eq u ipm e nt will be r ectified immediately by Gema lto. Installation of a diffe r e n t hard w are secur i ty module may h ave the following issues: l. Non-compliance with DoS approved desktop s o ftwa r e c o n figuration, voiding other war r a n ties associated with the e quip m ent and software. 2. In t er o perability cannot be gu a ranteed. 3. Support for fun c tional enhan c em e nts made to the sy s tem, as part of the PKI or future modifications cannot be guaran t e e d to be s u pport e d. 6. A descript i on of efforts m a de to ensure that offers are s o l i cited from as many potential sourc e s as is prac t icable. A Combined S y n opsis solicitat i on will be i s s ued under FAR Subpart12.6 procedu r es. The Combined Synopsi s / Solicitati o n will include this Justification, and will be publicized on FedBizOpps in accordance with FAR Subpart 5. 1 02(a)(6 ). 7. A det e rm i nation by the Contract i n g O f ficer that the anti c ip a ted cost to the G o v er n m e n t w ill be fair and reasonable. The Contracting O ff i cer w ill make a f a ir and reasonable price det e rm i n a t i on i n accordance w i th FAR 13.106- 3, and w ill be based on market research, comparison of p revious purchase prices found reasonable, or a comparison with simi l ar items in related indu s tr y. 8. A d escr i p t ion of the market surv e y conduct e d and t h e results or a statement of the reasons a market s u rv ey was not conducted. No m ark et r e s earch was c o n ducted, as the Gemalto products we r e tested and proven to work with the existing n e tw ork i n fra s tructure. T h e s o ft w are lic e n ses that will be deployed are a proprietary s o ft w are product that can only be integrated and maintained w i t h ad d i t i o nal pr o p rietary s oft w are code through aut h o r ized s o ft w are r e s e 1 l ers of the o r i g i nal m anufacturer. 9. Any other f a cts su p p o rti n g the use of other t h an f u ll and open compet i t io n. As this is a brand name o n l y justification, no one co n tra c tor's unique qualifications are used as the b a sis for this justification. Rather, the produ c t s identified by brand na m e h erein have b e en identified as the only products that will m eet the Department's requi r emen t s as part of the Department's storage environment. 10. Nonetheless, this Justification w i ll be p u b licized on Fe d B izOpps with the C o m bined S y n opsi s / Solicitatio n, in accor d ance with FAR 5.102(a)(6).
