Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 quote mark Synopses of Proposed Contract Actions quote mark US Army Corps of Engineers, Portland District intends to negotiate/award a sole-source, Firm-Fixed Price contract with Aquatic Informatics Inc 1111 Georgia St W Suite 2400 Vancouver, BC V6E4M3. The purpose of this acquisition is to acquire Aquarius Samples Software as a Service (SaaS) maintenance and support for an existing system. The system was originally purchased from Aquatic Informatics with Aquatic Informatics retaining full proprietary rights over the system Aquarius SaaS will be purchased for. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) for purchases not exceeding the simplified acquisition threshold. Furthermore, in accordance with FAR 6.302-1(b)(1)(ii), the item listed below are available from only one source. Item: Aquarius Samples Software as a Service (SaaS) A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 511210 Software Publishers. The size standard as defined by the U.S. Small Business Administration is $38,500,000.00. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 08:00 AM Pacific Daylight Time on September 24, 2015 an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
