- THIS IS A NOTICE OF INTENT, NOT A SOLICITATION FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institutes of Health intends to negotiate on a sole source basis with LexisNexis 1150 18th Street NW, Suite 600, Washington, DC 20036 for access to LexisNexis online services. The LexisNexis service is an essential component to the online services provided by the NIH Library to the offices within NIH, HHS and AHRQ. The information retrieved from this online access is required to support the mission of these components in the areas of legal, regulatory, public affairs/policy and biomedical research. It is a full-text retrieval of legislative, regulatory, newswire, medical and trade information. No solicitation exists for this requirement. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. The product is a commercial item as defined in FAR Part 2.101. The period of performance shall be for one twelve (12) month period, with options to renew for four (4) successive twelve month periods. It is believed that NexisLexis is the sole source for this requirement under the authority of U.S.C. 253(c)(1) as set forth in the Federal Acquisitions Regulation (FAR) 6.302-1 "Only one responsible source and no other supplies and services will satisfy agency requirements" because of the following: Lexis-Nexis holds proprietary rights both to the architectural design and retrieval software that govern electronic access to 3 billion searchable documents contained in the array of LexisNexis databases, which includes unique offerings such as Shepard's® Citations Service, Matthew Bender® treatises, etc. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. Below is the Draft Statement of Work. This is NOT A SOLICITATION FOR COMPETIVE PROPOSALS. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capability. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the requirements of the Statement of Work. Capability Statements and related materials must be received by the Contract Specialist, no later than September 18, 2015 at 11:00 A.M. Eastern Time. Written responses received after this date and time will not be accepted. A determination by the Government not to compete this proposed contract based on the responses received is solely within the discretion of the government. STATEMENT OF WORK Project Title: Consolidated Purchase of LexisNexis Online Subscription Services I. Statement of Work a. Background Information The LexisNexis service is an essential component to the online services provided by the NIH Library to the offices within NIH, HHS and AHRQ. The information retrieved from this online access is required to support the mission of these components in the areas of legal, regulatory, public affairs/policy and biomedical research. It is a full-text retrieval of legislative, regulatory, newswire, medical and trade information. In the past, this has been done through purchase orders on a yearly basis. Searches performed fill in gaps to policies, legislation, Shepard's citation searching of judicial court decisions, and business information, i.e., marketing support, licensing information, intellectual property such as patents, trademark, and copyright legislation and background information of people, companies, etc., useful information to avoid conflicts of interests, etc. The NIH Library would like to continue to provide this service but through a 5-year contract (1 base year and 4 option years). This will provide fixed rate access with cost certainty in future years, provide the NIH Library with predictable pricing, assist the library in planning for future budgets, and make the subscription easier to renew in the future with no lapses in service. b. Objective The specific objective of this requirement requires the contractor to provide online access to LexisNexis to NIH, AHRQ and HHS. Researchers maintain desktop access to the family of Lexis-Nexis databases. LexisNexis will provide all software upgrades and training required to use new products and system upgrades. II. Services to be performed a. General Requirements 1. Independently, and not as an agent of the Government, the Contractor shall furnish all necessary labor, materials, supplies, equipment and services (except as otherwise specified herein) and perform the work set forth below 2. The Project Officer shall monitor all activities occurring in this contract to assure that such activities fall within stipulations set forth in this contract. b. Specific Requirements Provide access to LexisNexis to NIH, HHS, and AHRQ. Researchers maintain desktop access to the family of LexisNexis databases and are provides software upgrades and training as required to use the new products and system upgrades. In addition, technical support and subject specialists assist in search formulation. c. Government responsibilities 1. The Government will be responsible for providing an interface via web links for users to access LexisNexis 2. NIH will be responsible for creating a system to validate security for entrance into the website. d. Reporting requirements and deliverables 1. The contractor shall regularly provide the Project Officer with usage statistics. 2. Usage data shall be broken out separately for NIH and for the individual HHS agencies served by the NIH Library/DLS.
