Description
Due to resent unrest and civil, and domestic disturbances, the National Guard of Tennessee has an urgent requirement to purchase two sets (Company Size) of Non-Lethal Weapons & Personal Protective Equipment for QRF soldiers (riot gear). Custody of these two sets will remain with the 251 st and 269 th MP Companies. The equipment must be identical in specifications and configurations and containerized and deployable for any of the two MP companies on call to immediately respond to State issues. Primary components of this purchase are tactical protective gear like, Face, Body, and Shin guards as well as non-lethal weapons and support items like Batons, Lights, Bullhorns and ammo pouches. This is a required set of MP soldier gear meant specifically to be deployed and utilized for state domestic concerns supporting Quick Reactionary Forces. This Justification and Approval covers the second set of Non-Lethal Weapon package specifically going to the 269 th MP Co. ITEMS: 129 ea EXPANDABLE RIOT BATON - Polycarbonate, Expandable, 36" 57 ea BODY SHIELD, NON-BALLISTIC - Dimensions 24 x 48 x 1/4" w Handle and Strap 129 ea SHIN GUARD (40% XL, 40% L, 20% M) - PVC Plastic with Nylon Strap 3 ea PORTABLE BULLHORN, WITH SIREN - >100DB at 10' Battery Powered 3 ea HIGH INTENSITY LIGHT 42 ea POUCH, 40MM CARRY (COYOTE TAN) - Nylon, MOLLE 10 ea POUCH,UTILITY,12 GAUGE (25 ROUND) (COYOTE TAN) - Nylon, MOLLE 42 ea POUCH, NONLETHAL GRENADE (COYOTE TAN) - Nylon, MOLLE 2 ea QUAD CONTAINER TAN 4 ea RACKING SYSTEM FOR QUAD CON 1 ea PMID - PACKING, MARKING, INTEGRATION AND DELIVERY Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization). FAR 6.302-1 - Only one responsible source. Reasons for Authority Cited: a. Identical items for configuration and interoperability, urgent fielding and required integration. This purchase is for set #2 of an MP Company's Non-Lethal Weapons (NLW) and PPE. The specifications, dimensions and packaging of the first set was already defined, solicited and purchased. The sets must be identical, and interchangeable to enable MP companies to train, and configure their TTPs under a common basic load. MP Companies will rotate on a QRF cycle, and these two sets must be identical to support their rapid response to domestic disturbances. b. Follow-on requirement of highly specialized equipment, in conjunction with the recently authorized Non-Lethal Weapon Program. The identified vendor, Aardvark, is working to develop the military items to be issued as part of the future MTOE gear for managing riots, civil disturbances and other engagements where non-lethal force is a mission requirement. The specifications for this equipment are proprietary and exclusively owned by Aardvark. c. Prior procurement history has shown only one vendor capable of providing a complete and acceptable offer. Market Research and Solicitation efforts during contract action, W912L7-15-F-0030, determined that the winning bidder provided a fair and reasonable price for technically acceptable products. Since the TN NG, QRF force was expanded to enable a second MP company to answer the call, the need for an identical second set of gear was also required. Recent disturbances in Tennessee and in neighboring states have made this requirement of a more urgent nature and thus the desire to obligate funds for immediate equipment fill. d. The most efficient and appropriate process for this acquisition is to proceed with a sole source acquisition based on three key points. 1) The equipment specifications previously purchased as a deployable set of Riot gear is proprietary and unique for Aardvark. 2) Previous solicitations for this same equipment have yielded only one vendor that specialize in Non-Lethal Weapon PPE under this configuration. 3) The TN JFHQ has an urgent need to ramp up two MP Companies to perform QRF duties for civil disturbances, and this set must be identical for consistent TTPs and quickly fielded. This MP NLW personal protective set is one complete purchase that must be deployable and integrated within existing equipment and tactical configurations. Actions to Increase Competition: Notification of intent to Sole Source procurement of this NLW gear is be posted to the Government Wide Point of Entry (GPE). Previous solicitation attempts have yielded no other capable vendors; however, this action will still be posted again to notify the business community of opportunities in this industry. This action is a one-time requirement based on the urgency of need and prior history of only one capable vendor. In the future, this equipment will be fielded through traditional Army supply channels as proper LIN and NSN items as part of unit MTOE equipment. For this immediate need however, this second advanced set of NLW gear is an urgent requirement to facilitate Emergency Readiness of Tennessee Guard units on call. The larger effort to field all MP units within the entirety of the States and Territories is centrally managed through the National Guard Bureau's NLW Program.
